k1--IMBRA--DENIALS/ACCEPTANCE

Timeline

i filed my k1 visa in 08/2007. i received the first letter of stating that my application was received and it has been pending since then. i am a convicted sex-offender and i fully disclosed this information in the application. i have received an email from USCIS stating that my case needed " further background check ", that was about 6 months ago. i calle duscis but i was told i had to wait 6 months for processing to continue and that if i did not receive notification after 6 months to call customer service back. well i will be calling again this week to ask why my application is our of processing time and i will hopefully get further information at this time but i fear that this will continue on and on.

is/has anyone here been in this situation? do you know if there are cases denied r/t imbra? have you waited this long without a decision? please give your feedback if you can... God bless

Just from people who have posted on this site, I don't know that any sexual offender has been successful in getting a K visa petition approved. This isn't to say that there hasn't been anyone. VJ only has a very small portion of people petitioning. There is another thread in this IMBRA section posted here:

There are approximately 66 posts in this thread, however some are from people who are in the same situation and could prehaps provide you with information as to their journey.

This is NOT and IMBRA question. If your offenses qualify under the provisions of the Adam Walsh Child Protection law you are deemed ineligible to petition.

Part of the purpose of IMBRA is to disclose information to the beneficiary about your civil or criminal history, assuming that the petition reaches the interview stage. Therefore, it is important that your fiancee knows the details about this well in advance, otherwise it will be a shock for her at the interview.

If the petition fails at USCIS, you might want to research into whether a I-130 would be more appropriate, which would require marriage in her home country of course.

Good luck, we are in the same boat and its been 4 years...... every request for answers is answered like this "we will process your request for information you should here back in 60 days. I have filed complaints because complaints have not been answered......I hired a attorney and refiled a i-130 we made some progress but its been slow we are supost to have a answer on our waiver in next 7 days but some how i dont think we will have it and attorney expects to have to file more papers to get a answer.

Don't listen to some of these people , they don't know what they are talking about

This is a lie, you have to becareful who you listen to on these forums , a few people know what they are talking about, the rest only pretend to know.

One of the users on this forum that had a sex offense got a K3 approved, but met the requirements by sending all proper documentation.

Look for "adam walsh act was beat"

I dont know if K3s are looked at any differently from K1's when it comes to this
