N400 Interview Cancelled with no reason

Hello all,

I have gone through the archive in this forum and other fora for cancellation of interview. Reading them gives me some consolation and continuous painful waiting. However, my case seems to be unique from all other cases that I have read so far.

My N400 application priorty date March 2008 and interview date was scheduled for September 30. I received another letter within two weeks interval that my interview has been cancelled. The letter reads: This is to advise you that due to unforseen circumstances, we have had to cancel the previously scheduled interview on September 30, 2008 for above application. We regret any inconvenience this may cause. We will advise you of any further action taken on this case, including rescheduling interview information under separate notice.

I called my attorney and he confirmed that he received the same notice. I was curious to know what could be the reason since I have read a lot about cancellations lately. The only reasons he gave me was that my interview date fell within end of government fiscal year. Therefore, there was likelihood that due to this, my interview was rescheduled. Secondly, it could be that many people were scheduled for interview within same time with limited USCIS personnel to conduct the interview.

Well, it has been more than a month and half since I received the cancellation notice and I have not received another letter for the reschedule. I have not read where some stayed this long without reschedule notice.

The uniqueness in my case is that I called customer service number and found out that my receipt number could not be located in the system. The system said that status of this receipt number cannot be found on the automated system, please check your receipt number again. The customer service said the same thing, they could not locate my case.

This is not clear to me. At least, I read that when interview is cancelled, the automated system and customer service should be able have at least the information.

Please help me clear this fuzzy situation.

Regards

Tony

I don't see the reason to see uniqueness from your story.

It is discussed several times.

There may be a couple of different reasons.

For an example,

1) USCIS District Office is renovating or moving to different location.

2) USCIS District Office is runnig out of resources because somebody goes on vacation/sickness, or somebody scheduled interviews more than they can handle.

3) USCIS has resource re-allocation for preparing new fiscal year thing since most of visa quota will restart from October 1.

4) USCIS anticipated new hired people to be on case handling, but they found out that training didn't go well, so they have to reschedule some overload cases with current available manpower.

5) etc...

USCIS National Customer Service have access to service center processing, but they don't have much of information from local District Office processing.

N400 is considered as local District Office processing.

It's your laywer's job to catch USCIS district office to get some further information if he/she feel something wrong.

Sorry for the late reply. I was not sure how INFOPSS will play out when I have an attorney representing me. I have been trying to get some words from the attorney. After series of phone calls to her office, she finally told me that my file is pending and that USCIS will reschedule my interview at their own pace. I wish they had not scheduled my interview in the first place until they got their act together, at least I wouldn't be worried of what could be going on. Life goes on without sleepless night.

Who knows what could be the out come if I schedule InfoPass appointment. I have heard that USCIS will not talk to you directly if you have a lawyer. I could get there and be told that they won't speak to me but through my counsel.

It has been more than two months since interview was cancelled.

Hi there,

I know it says I am applying for a K-1 fiance visa (which I am) but I felt to comment on this since before I became a citizen on September 31 the same thing happen to me- I had my interview set for aug 1, and then they cancelled it and moved it for sept 24- the following tuesday I became a citizen- don't worry you'll get rescheduled- Unfortunately USCIS can be quite disorganized- I applied in January 08 and got citizenship in Sept 2008 BUT (and get a load of this!) my dad applied April 2008 and became a citizen in August 2008 - earlier than me and he applied way later- so things get can be very weird with the timing situation and citizenship but you'll do fine...

hope that helps

I see ur at the fairfax VA office. I had my interview there a few weeks back, but due to a mysterious file on my case -----they have to get the file from nebraska before they can make a decision. Maybe someone noticed that you had an extra file and they caught that after they had sent out the original interview letter. My interviewer stated sometimes they catch it and in my case they didnt, lol He did state quite often these "mysterious" files are caused by extra stuff a lawyer has sent in, or something that has gotten misplaced and someone didn't know where to put it, and starts a new file.

As well the fairfax office is a busy one, they have hired extra staff and they try to conduct around 500 interviews a day! And at the fairfax office, majority of the time you do the oath the very same day!. The fellow gave me NO timeframe when i can expect an answer. I got a N652 and it stated they have up to 120 days, after that i can contact them! best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1
