Thanks for the responses. I'll just try to clarify that what I'm looking for is some knowledge of actual cases similar to this; AND if you know directly of anyone who might have filed for support or anything else.

What is she looking for? What is she trying to accomplish? It would help if you tell us.

Exactly. We keep asking what she wants besides to annul the marriage and get on with her life. The closest you've come to answering that question is you want options related to "support" which would mean "money". That you are getting no suggested options should give you a hint.

It's an unfortunate situation but short marriages don't usually warrant spousal support even in the US with direct access to family courts.

As should be abundantly clear, she is in a DILEMMA. She doesn't know what to do. We are trying to help her out of that dilemma by finding out what her options might be. Then she can think it over and decide. It's all part of the decison making process, understand? The only thing I"m finding out about most of the suggested options is that so far we haven't heard from anyone with real knowledge in this type of case. I appreciate the effort but we need some hard information from some experienced or just knowledgeable people who can cite actual cases. If you don't have that, that's fine; there is really no need to respond.

You aren't hearing options besides do nothing or an annulment because there really aren't any. As crappy as the situation is, she has no monetary claim. She can't force the husband to obtain a divorce, which wouldn't be recognized in the PI anyway.

Her only option is to file an annulment.

Grounds can be-

A. Psycohologically incapacitated

Psychological incapacity refers to a mental and physiological incapacity of the spouse to comply with the essential marital obligation of marriage. The following are some of its manifestations:

1. By the refusal of one spouse to live, dwell and cohabit with the other after marriage, without any fault at all from the aggrieved spouse.

2. By the deliberate refusal to give support to the other spouse, or their common children

B. Presumptive Death

The absence of the spouse for 2 or 4 years, depending on the circumstances, may be enough to ask the court for a declaration of presumptive death of the absent spouse, in which case the petitioner may again re-marry.

Ofcourse, since th wife doesn't know where his husband is...where will the summons be served? She will have it published in the newspaper of general circulation for 28 days (I am not sure).

"Square one" is something you apparently did not bother to read. I made it plain in my first post that she was seeking options. You respond by asking what is she trying to accomplish??? If she is seeking options it's because she hasn't decided! Like I said if you don't have real knowledge in this area and can't back it up with an answer that is sourced in some legal opinions why bother to respond? Just leave it alone.

Annulment cases in which petitioner's are nowhere to be found can still be pursued. Though, she/he needs to give the latest address (the one she/he knows) of his/her spouse... and/or she can file declaration to nullify marriage, since they didn't live together as husband and wife (didn't they?) most definitely the marriage will be terminated...

I've been reading this thread, actually, what I understood is you want to know the options... Posters here have been giving the options, in which, the only option I can also see is to file annulment or declaration to nullify the marriage so your friend can go on with her life... If money is the problem for filing the case, here in PI there are Public Attorneys... she can go there and ask for assistance... My best friend's aunt (who's now married to an American) was married to a Filipino before she married the USC guy... She went to Public Attorneys' Office and her annulment granted for just spending Php 3,000!!!

My source is Family Code of Philippines. Ive filed two annulments and it was granted. In one of the hearings I attended, I saw one Flipina and US Citizen going through an annulment. Also, I have an Uncle who is a US Citizen and he got divorced from his Filipina wife here in Philippines without his wife knowing it.

Looking at the input and responses, it really seems that you've got a fair skepticism over what is said over the Internet. (Not a bad thing and probably a good thing in terms of making sure your gained information is accurate.)

At this point, it sounds like you're trying to get legal representation for your friend. This may be a situation that will not be too common on this board since most of it's members are here to gain information on bringing their beloved from overseas as quickly as possible - not stringing them along and then disappearing.

You may want to consider seeking legal coucil on behalf of your friend with an attorney here in the states or your friend should seek coucil with an attorney at home. You'd probably get a straighter answer with less headache of going in circles here.
