Hello,

I am trying to help someone out. She married an American in the Philippines four years ago but he seems to have lost interest as she is still waiting for her visa. She is not even sure if he ever filed any petition for her. He claims to be unemployed and uses that as an excuse . He has not visited her in a long time, probably 2-3 years. What I want to know is does she have any legal options here in the USA? Can she appoint anyone here to act for her? Is there any kind of petition she can file? I'm sure this has come up before but I can't find any information on it. Thanks for any replies.

Here are her options:

1. Seek an annulment of marriage on the grounds of fraud or psychological incapacity.

2. Contact the US embassy/consulate and petition for spousal support.

Only thing I can think is Annulment based on abandonment, if that can be done.

im not trying to sound like a mmm rude person but if it has been that long why dont u ask her for the guys phone number and address and u can find out if he did anything by just calling him up? it could be he married someone else and divorced her with out her knowing? good luck i hope someone has a better answer for u than i do.

Good question. I think she wants some kind of closure, to either give up on him or perhaps seek a legal remedy. I have heard this story before and it seems on the surface that the K-3 wife has no options if her husband hasn't filed or simply abandons the petition. I'm trying to find out if in fact she can do anything in terms of a legal remedy here in the USA. Sonomacountygal's response is interesting, just wondering if anyone has ever tried it?? I want to find some case histories.

Sounds like an annulment is in order, which can be expensive in the Philippines. The husband sounds like a real dirt bag, unless he passed away of course. This will also make any future marriage/immigrations a lot more complicated.

It would have been better if the husband cooperated by having a divorce processed in the US without the need of lawyers.

No, you didn't ask about "avenues". You asked about "remedies". Other than annullment, just what is it she wishes to "remedy" through legal action? Is she looking for spousal support after a brief marriage with no cohabitation? Is she wishing to come to the US? What are we talking about here, just a fishing expedition?

This is an unfortunate situation for certain but other than becoming free to marry again, I'm not sure why or what else needs to be done.

I personally know a man married to TWO Mexican women. One he married one the U.S. side of the border, the other he married in Mexico. I his puny little mind he thinks this is legal. He has since abandoned the woman he married in U.S. All live in Mexico.
