File AOS before married two years?

Hi my husband just got here in August on a K-3. We will be married for two years May 26,2009. Is it better to wait and file AOS to make sure it is approved after the two year mark? or is removing conditions relativly easy?

Any suggestions?

Sent I-130: August 15, 2007

Received NOA1: October 3, 2007

Sent I-129F: October 4, 2007

I-129F NOA2: April 3, 2008

NVC Received: April 22, 2008

Left NVC: May 15, 2008

Interview: June 18, 2008

U.S. Entry: August 11, 2008

AOS

Sent AOS package VIA Certfied Priority USPS: May 28, 2009

Arrived at lockbox: May 31, 2009

Received AOS & EAD NOA1 June 8, 2009: NOA Date June 4, 2009

Received Biometrics Appointment Letter June 13, 2009 Appt date June 24, 2009

EAD Received in mail 07/20/2009

Received Interview letter 8/1/09 Interview 09/15/09

Timeline

Some do wait and file I-485 close to 2nd wedding anniversary to avoid removal of conditions.

You may want to study the I-751 guide and see what paperwork is needed to remove conditions, if you can avoid doing I-751 and it's paperwork it saves you extra work.

You can apply for EAD before AOS, the fee is $340, which is less than the fee to remove conditions, K-3 EAD is Code (C )(9 ) Life ACT.

Note: You need to file AOS within 1 year after visa medical, or you will need to do a full I-693 medical which is added expence.

Yes, you could file on line however, you will still need to send evidence to USCIS, so it is better to just file the I-765 to the service center having jurisdiction over place of residence.

The online e-file system is handy for renewal of EAD
