The fact is that I and my wife are planning to move to the USA in 2010, when I will start my MBA there...

But I will be applying in 2009, when I won't have my visa/green card yet. So, should I apply for a student visa as well?

The problem is that my wife will be engaged in schooling (master) in italy until september 2010, and I'll eb moving to the US in July 2010... What can we do then? I imagine I cannot apply for a student visa while filing for DCF right? Any way out?

Please help, this is getting crazy and I don't see a way out... :(

I was thinking: we file for DCF next year in July... let's say I get my visa by november or December... I go to the US to activate it at the beginning of the 2010 so I won't need a student visa... and then I move to the US in June/July to activate it waiting for my wife... Can it work? Pls help!!

The simplest route that also uses the immigrant visa in the intended way is to put off starting your MBA until after your wife is ready to return to the US and apply through DCF around April or May of 2010.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Another suggestion is to choose a program that allows for spring entry, that way your wife can complete her studies in Italy in September, then you can move back together for you to begin your studies the following January

The immigration process often requires couples to adjust their priorities, as the process doesn't adjust for us.

You might be able to come to the US for a short time, then leave again soon for no more than six months without any problem.

Facts are cheap...knowing how to use them is precious...
