Hi everyone,

I have sent all the necessary documents to Chicago about 3 weeks ago and received NOA for I-130, I-131, and I-485. However, my I-765 was returned to me due to the "outdated version of the form", which expired on 8/31/08. They told me to call this request form line and I did. But they sent me the same old version of the form!! I am very frustrated. On USCIS website, it says that they don't accept the old version of the form, but that's all they have on their website. Plus the request form line also sent me the same damn thing! Has anyone experienced the same thing? Is there a new form out there?

Please someone help me! Anything will help.

Thank you very much.

You need to look at the bottom of form I-765 "Form I-765 (Rev. 05/27/08) N" and USCIS website:

Edition Date : 05/27/08. No previous editions accepted.

"OMB No. 1615-0040; Expires 08/31/08" is NOT the expiration date of the form, is the date that USCIS needs to compleate an audit of the form to satisfy the requirements of the Paper Work Reduction Act, per Office of Management and Budget. OMB You can read about Paperwork Reduction on page 12 of I-765 form's instructions.

That is the most recent version and what USCIS indicates as the accepted form.

Dis you code it correctly on part 16, (C )(9 ) based on pending I-485? Send it back and attach a cover letter, citing USCIS website, and highlight the date at the bottom of the form.

Also when you do send it back to them you will now need to attach a copy of I-485 NOA 1 letter to prove NO Fee required for I-765.
