Hello Again,

I've tried searching VJ for this answer but I cannot seem to find it. For question 16 what is my eligibility category?

Is it (a)(6)-Nonimmigrant Fiance(e) of US Citizen- File your EAD application if you are filling within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ©(9).

I have not filed for my adjustment of status yet as I would like to file for the EAD at the same time. Does this put me into the above category? I think it does, but I'd love to hear some confirmation!

For K-1 it is ALWAYS (C )(9 ) based on pending I-485, this is the FREE EAD provided for as part of AOS.

(a )(6 ) EAD = TEMP 90 day EAD based on entry date, it costs $340 and since it can take 90 days to get, it tends to always be expired before USCIS can issue it.

NO, You file I-765 with I-485 send then together in same envelope to the Chicago addess indicated by I-485. Keep in mind I-765 and I-485 need to be treated as separate petitions, NO sharing of evidence passport photos, etc.. they are jsut sent together to USCIS.

OR you you will need to do as you say wait for I-485 NOA in order to file EAD

Hi, I've been reading this thread and I would like to know your opinion on my case. I passed my I-765 together with I-485 last Sept and the eligibility code I entered is A6. I realized now that it should be C9. Does that mean that my I-765 application will be rejected due to wrong code? Thank you in advance for any reply.
