:help: My FI and I are getting very frustrated with the thought of waiting and waiting, as I am sure so many of you are. On his visit next month, we are seriously debating just getting married and applying for a k-3. MY fear is the length of time it takes. Is it really more than the K-1? Does anyone have any knowledge or opinion on this? Thanks so much.

each case varies so its hard to say for sure :)

we are probably going to do the k-3 while i visit on the VWP and then come back to england after 90 days and do the rest of it.

i dont think there is too much in it right now, your gonna have to be apart for a good few months either way :(

ive been looking at peoples time lines, and its hard to say which is going faster.

of course you also do the CR-1 which could save time getting a greencard, but you wont get a SSN as early as you would via the K-1. might not be an issue, but my partner was told i couldnt go on her work medical insurance unless I have an SSN...

I would suggest, just be patient. Once you get your NOA2, everything speeds up. To do a K3 takes a year or sometimes more than. CSC is like that, really slow, but you will get it anyway. Good Luck

My husbands K-3 took 6 months to get once we applied for it, which was about 4 weeks after we got the NOA1 for I-130. The hold up was a mistake that we made so really the K-3 can happen in about 4 or 5 months. Personally I cannot say how quickly a K-1 processes.

I cant say which one is the better route, but when comapring time frames ensure you are comparing one that are going through the same centres that you will be utilizing. Some are fatser/slower than others. best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

From my experience, the K-3 is taking us about 2 months longer than a K-1. My (now) wife is from Russia, and it seems to take longer for them.

We started the K-1 process, and due to personal issues, we decided to get married. If we had waited for the K-1 to finish, she could have been here in the USA *now*! But instead, we must wait anywhere from 4 to 5 months from now, for a total of about 8 months from the NOA1 date. We're hoping for sooner, but looking at processing time for others from Russia, we're not counting on it.

I haven't thoroughly researched processing times for England/UL, but they don't seem to take as long as Russia.

Best wishes for a speedy process!

2005-08-10: Met Natalia and fell in love. Too bad she didn't.

2006-01-13: Married. Biggest mistake of my life.

2006-03-07: Began the I-130/I-129F process.

2006-11-01: POE - JFK / Home in Austin!

2006-11-15: She hits me and continues pattern of abuse.

2006-11-16: I filed for divorce.

2006-11-17: Wife is served divorce papers; she and daughter return to Russia.

2007-12-08: She returns to Russia "for the holidays" (lied to lawyers and court).

[many more ups and downs during this time period - mostly downs]

2008-03-26: File for bankruptcy.

2008-07-30: Bankruptcy finalized.

2008-08-27: Divorce final. Started piecing my life back together.

(See my timeline for details.)

Disclaimer: I'm just a guy who married for love, but she didn't! All she wants is money and a green card.

From looking at the timelines it dosent look like a single I-129F (for spouses or fiancees) with a received date after March 6, 2006 has been approved, which means that timelines will probebly be longer for tke K-3 in the future. My I-130 was appreved a few days ago. Until the IMBRA stuff is sorted it dosent look like either the k-1 or k-3 are moving. So at least something is moving forward :D

If nothing has happened by the time you get there I would seriously consider getting married and starting the CR-1 process and then going the K-3 route, with whatever new form they come up with, it they ever start approving I-129F's again.

yeap, with the recent addition into the process of them now doing background checks on petitioners as well as beneficiaries, its all going to take longer. So looking at timelines for the past 6 months to a year probably isn't going to help you much in deciding which is faster.

I'm not sure if they're doing checks on K3 petitioners as well as K1, but you'll probably want to look up some information on this to find out.

It may even be quicker now to just get married and do the CR1 route.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!
