Firstly who are you submitting an I-130 for?? Spouse? Step child?

Affidavit of support will be requested by NVC after they start processing I-130 for a family based visa.

Who's Birth Cert are you talking about? US citizen's or intending immigrant?

If applying for a step child, the marriage that made the child a step child needs to have taken place before child's 18th birth day.

US Citizen cannot file an I-130 for IN-Laws, Aunts, Uncles.

You need to provide 2 things, copy of your birth cert proving that she is your mother, and copy of certificate of US Naturalization.

Only US Citizens can petition for a parent.

LPR's (Green-Card holders) are limited top filing petitions for Spouse, and their children.

Who May File Form I-130?

1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:

A. Your husband or wife;

B. Your unmarried child under age 21;

C. Your unmarried son or daughter age 21 or older;

D. Your married son or daughter of any age;

E. Your brother(s) or sister(s) (you must be age 21 or older);

F. Your mother or father (you must be age 21 or older).

2. If you are a lawful permanent resident of United States, you may file this form for:

A. Your husband or wife;

B. Your unmarried child under age 21;

C. Your unmarried son or daughter age 21 or older.

Who May Not File This Form I-130?

8. A grandparent, grandchild, nephew, niece, uncle, aunt, cousin, or in-law.

i too am looking for info to petition my mom. from what i gather, this is all we need to send:

1. Form I-130

2. $355

3. Birth certificate showing her as my mother

4. proof of US citizenship (is US passport ok?)
