My family migrated here in hawaii since may of 2003. the problem for me now is after i've received my GC which i got for 2 months, i eventually go back to the philippines to finish my study in college but before that i also filed for the reentry permit so that i can stay in the philippines for not more than 2 years. and i've finish my college for 4 years so i've got 2 reentry permits now.

what do you thinks guys? can i apply for a citizenship already? because since 2003 my parents stay here for 5 years, 4 months, 6 days. but they also go back to the philippines but only for weeks. not like me that i stayed outside the US for years.

An applicant is eligible to file if, immediately preceding the filing of the application, he or she:

has been lawfully admitted for permanent residence (see preceding section);

has resided continuously as a lawful permanent resident in the U.S. for at least 5 years prior to filing with no single absence from the United States of more than one year;

has been physically present in the United States for at least 30 months out of the previous five years (absences of more than six months but less than one year shall disrupt the applicant's continuity of residence unless the applicant can establish that he or she did not abandon his or her residence during such period)

has resided within a state or district for at least three months

It appears your time to wait restarts each time you are absent from the United States for more than 1 year. You can start counting 5 years again from the date you last came back after being gone for more than a year. You will also have to meet the physical presence requirement of 30 months in the United States within the previous 5 years. When you meet both of those requirements, you can apply.

oh ok sir. i thought my reentry permit will be a good reason that i did not abandon my residence here in the US. :( poor boy..i will wait for 5 years before i see my fiancee again. :crying:

The reentry permits did keep you from abandoning your residence, but simply having residence is not all of the requirement. You don't meet the physical presence requirement yet.

ah..but are there are added years for me in the 5 years? i min maybe for just 1 year so that i can stay here for the last 4 years and apply for the citizenship?
Reading the instructions for the N400 app should clear everything up for you.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

The instructions specify exactly the information you need. Really. It may come as a shock, but the government really does what you to read those instructions. They spent a lot of money developing and distributing them.

There is more than 1 requirement. You have to meet all of them. Even if you are never gone for more than 6 months, you must also be physically present in the U.S. for a large portion of the total time. Go through the list of requirements. Once you meet ALL of them, you can apply.
