POE ENTRY WITH EXPIRED GREEN CARD

I JUST GOT BACK FROM FRANCE WHERE I HAD THE NOT SO NICE WELCOME BACK TO THE US.

MY GC EXPIRED SINCE MAY 2007 AND MY HUSBAND AND I APPLIED TO REMOVE CONDITIONS IN FEBRUARY 2007 .... OF COURSE MY ONE YEAR EXTENSION ACTION OF NOTICE EXPIRED BUT IN THE MEANWHILE WE GOT A STAMP ON MY PASSPORT, THE OFFICER DID NOT WANT OT HEAR ANYTHING ABOUT THE STAMP AND WAS PRETY RUDE WITH ME, WE TRIED TO EXPLAIN HIM THAT MY CASE BEEN APPROVED ON THE 24TH SEPTEMBER 2008 AND THAT IT WAS OVER A YEAR WE WERE WAITING FOR MY CASE TO BE APPROVED... ANYWAY HE PUT A BIG B ON THE CUSTOM CARD SO WE WENT TO A LITTLE OFFICE AND A GUY FINALLY STAMPED MY PASSPORT, IT WAS A REALLY BAD POE EXPERIENCED.

I' M GLAD THAT I' M FINALLY HOME. MY HUSBAND WAS REALLY FRUSTRATED WITH IMMIGRATION AND SO I WAS.

SO NOW I' M WAITING FOR MY NEW GC THAT I HAVE BEEN WAITING FOR 1 YEAR AND 7 MONTHS.

When did you get the I-551 stamp in your passport. It is only good for 1 year.

My wife has travelled out of the country twice this year with the I-551 stamp only and had no problems

3/06/06 - AOS/EAD/AP process begins

3/31/06 - AOS/EAD/AP package Fed Ex'd to Chicago

4/03/06 - AOS/EAD/AP package signed & received

4/10/06 - NOA1's received for AOS, EAD and AP via U.S. Mail

4/11/06 - All 3 checks cashed / $745.00 poorer but worth every penny

4/27/06 - Receive Biometrics appointment letter scheduled for 5/11/06

5/11/06 - Biometrics completed

6/02/06 - Receive notice that AOS only has been transferred to California to speed things along

6/07/06 - E-mail that AOS received in California

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks

6/19/06 - Card arrived in the mail.......

3/08/07 - Trip back to Peru for 10 days and our Religous Wedding

3/2007 - We're Pregnant

12/19/07 - Sebastien Joshua born 8:29am 7lbs 2oz 19.5"

3/14/08 - I-751 Removing Condition is in the mail

3/20/08 - Checked cashed

3/17/08 - I-751 Package signed and received

3/24/08 - Case moved to Vermont

4/17/08 - Biometrics completed

4/21/08 - Touched...........

6/16/08 - Touched once again........

11/3/08 - Touched again.. this is begining to feel good

I got my Stamp on april 28th this year so it was valid and we went ot uscis office to make sure we could come back in the country, the POE was Washington DC.

I went to Canada last week and came back on an expired GC with an extension stamp in my passport and had no problems also. You probably just had the bad luck to get an a$$ of a border agent rejane.

Those of you who haven't had problems at the POE should count yourselves lucky!! My British husband has never entered this country, even with his valid greencard, without some sort of hassle. I'm so fed up I could scream. We are applying for naturalization as soon as he is eligible in June so we don't have to put with this immigration ####### anymore.

7/24/09: Biometrics

10/08/09: Interview

11/21/09: Receive oath date

01/22/10: Oath Date

Timeline

When I first got my GC it arrived while I was in Germany, I had the I551 stamp in my passport. Back in Charlotte, NC I was put into a room with all "suspects" (aka people who they suspected to try to sneak into the country), my cell phone, purse, luggage was taken from me and I wasn't allowed to call my DH who was waiting outside (with the GC in his hands) to pick me up. After a little over an hour another officer got me out of there, said they checked my immigration status, apologized and gave me my stuff back. Some people in that room had been there for more than a day (!).

When I traveled wiht my valid GC this year (POE Washington DC) I had no problems at all... I think it really depends on the officer... If they want to give you cr**, they will.

I think it does not matter your POE... it's the officer... I have had good and bad... some who barely read your paperwork, just make sure it looks fine, and other who take you to a back room and look you up... sometimes I think this is also random... most of the times its probably the officer, Luckily I don't tend to have have that problem too often or I would for sure not travel... its annoying enough getting through the airports

We've only made one trip since my British hubby has has his green card and on the way back from vacation last year (POE - Newark) he was hassled in line by the immigration officer, for what appeared to be no good reason. He had a valid unexpired g/c and was asked to recite the last four numbers of his SSN (off the top of his head). That's great for those of use that use of SSNs on a daily basis and have for years...but it put Richard on the spot. The officer could see it made Richard nervous and then continued to grill him. We had been in the Caribbean for a whole seven day, for pete's sake. He let up when he saw the line was getting really long behind us and he had already had his fun for the evening.

I'm hoping for the 10 year card to arrive before our repeat trip in December. I have taken the precausion of booking a direct flight to avoid any delays, in case he still has to use the expired card and the "letter." He is also applying for Naturalization to avoid these issues in the future and he wants to vote.
