Timeline

Does anyone have experience with filing a complaint against DOS regarding the administrative processing time? I am wondering how it will affect our case if I complain. I was reading on the DOS website that the special security clearances are usually completed within 20 days (per testimony on how the process works made to congress). I feel that cases that go beyond that time should be told why and they should have a reason other than the country the person is coming from. I'm interested to hear what other VJers think about this. :)

I think it goes like this.

When in doubt, blame security checks. (USCIS, now part of the DHS)

Security checks falls under state secrets, because it means revealing classified data only shared with people who have a certain clearance.

Since the DHS and DOJ (incl. FBI) are the de-facto agencies which are responsible for such checks, are cabinets that's part of the Executive Branch, and the Executive Branch has chosen to.. expand it's secrets, and refuse to cooperate in sharing them, I believe filing a lawsuit against them sort of falls under the "snowballs chance in hell" of succeeding.

You cant complain and make a difference, but you can tell your congressman/senator in your state and make a complaint that the processing time in DOH or any government agency is not acceptable. But remember, each case is treated differently and depending which country you are from will determine if you have a valid case to complain or not. For terrorists countries (or known terrorists) the waiting time will significantly be longer, since we are dealing with US security. In my opinion, you dont have a valid case to speed things up, even if you get President Bush to back you up.
