Hi, I just filed for I129F in Aug. I've got my NOA1 and waiting on my NOA2. I was wondering if anyone could answer my question. My fiance is a citizen of Sri Lanka but he has been in the UK for approximately 5 years. Currently he is going to school on a student visa in the UK.Does this cause any problem getting the K-1 visa? And does he have to go back to Sri Lanka for his interview..can the interview take place in the UK?(Can he get his Visa in the UK)?

Its going to be 2 months and it's really nerve wrecking. :crying::o(.

July 97 We met for the first time in Sri Lanka

Sept 97 Left Sri Lanka (Kept in touch for 5 yrs via phone and air mail

Aug 05 Met in London for ONE hr during my transfer flight back to United States. (Fiance on student visa-UK)

Sept 06 Went to London for 2 wks (it went soooooo fast :o()

Aug 08, 2008 Sent out I 129 F

Aug 13 I 129F received at Vermont Service Center

Aug 14 NOA1

Aug 19 touched.......waiting for my NOA2...i want to skip the touches :-(

Jan 21 NOA2 as written on notice

Jan 23 NVC received petition

Jan 26 NVC sent out petition to London Consulate

Jan 26 2009 Received NOA2 copy via air mail (letter states approval Jan 21st) YEAAHHH!!!![/color]

Feb 5 2009 letter sent out from UK embassy of US (package 3)

Feb 9 2009 fiance (petitioner) received package 3

Jun 23 2009 sent package 3

Jun 26 2009 embassy received package 3

July 23 2009 fiance received package 4 for interview dated August 7, 2009 @ 8AM

August 7, 2009 APPROVED!!!!!

Nov 4, 2009 POE in New York

I am 99% sure that only the place of birth has to be the country where the interview needs to be.

Or, it has to be in a country where they are citizenship to. (not the place of birth)

The interview will have to be in Sri Lanka.

About the waiting time, just be patient.

hi there, I think we re in the same situation! my fiance just got his visa from london. Hes moroccan and on a student visa in the uk. hes been living there for five years too!! so Technically yes you can! it will all go wrong, if ur fiance's uk visa expires before getting his interview, if u see what i mean. hope this help

Thanks so much guys. Now i have a little bit of hope and a little bit of uncertainty. Unfortunately, his visa expires in Mid Jan of 2009, but he is going to apply for extension since his finals aren't till the next month. But i'm thinking the copies i sent of his passport show expiration date in january. ahhh...i know its better to be patient... but with everything in the air..not knowing what's going to happen is really scary :( I haven't seen him for 2 years :-(...thanks again...

and congrats on ur fiance getting his visa. Where did he get his visa to?

oooooh I seee. Well my fiance just got a two years work permit from the UK home office bcoz he just graduated! soo his visa is valid till August 2010! soo that was not so bad. as i said the only uncertainty is if hes uk visa expires then ud gonna have to put a formal request to transfer ur case to SRI LANKA. but between us, u wudnt want that, as the London embassy seems to be pretty smooth and laid back. and he got his visa to the USA where we gonna be happy forever!!!

You might want to check this with someone more experienced/knowledgeable than me, but I believe that the one absolute condition that must be met for approval of the I-129F petition is that the petitioner and beneficiary have been together in person within the past two years. If you haven't, that might make the rest of this moot. I'd definitely check. Good luck!!!
