Hey again everyone - so here's the deal! My fiance is coming here in December and our K1 application will be in the works at the time - we're both so worried that he wont get through! Does anyone know of anyone who has had any problems or have you personally?

He has car ownership documents, plane tickets, previous plane tickets and other stuff to show he'll be going home so it shouldn't be a problem, but still - better safe than sorry!

well we are in the process at the moment awaiting out NOA2, I have booked a flight to Texas over the Christmas holidays and that might meen delaying my packet 3

I am nervous as well but I will have my return ticket and a letter from my employer stating my return to work date and that I am on holiday

I will be totally honest with all imigration questions that may be raised, and if asked will tell them that I am in the process of obtaining a K1

I have seen lots of VJ members travel whilst in the process so it is a risk I am willing to take, nothing in life is guaranteed and I dont want to be away from my finance over Christmas and New Year

Lets just hope that imigration in the US is in the Christmas spirit and does not give us a hard time

If he's working he could get a letter from his employer saying he'll be back such and such a date.

I am hoping the exact same thing, christmas spirit all the way! But as you said, there is no guarantee. It must be so hard being denied, but he will get a letter from his employer I hope!!

Do you know of anyone on VJ who has had the misfortune of being denied?

No sorry I dont know anyone that got denied while waiting, but it will have no effect on the process

I know someone who got denied before they filed for their K1 with the big entry denied put in the passport and they have just got their NOA2, so even if I get denied it wont have any effect on the application, if it did then I would not be taking the chance. I am also going to take a copy of my last pay slip as well. I dont know your situation but just take a copy of everyting that shows you have a tie to the country, motguage....lease.....

I have a good feeling about it, I am going to save my panicing for the line to immigration ha ha

It's done now flights are booked so no point in us worrying about it till we have to

We will have a great Christmas with the ones we love

Dont worry about it sorry if I was not clear, no it is me that will delay the process, if I am lucky enought to receive my packet 3 before I am due to go I will not send it in till I get back, as if I send it in and get my interview date before I leave for the Christmas holidays, I would have to go at Christmas using the K1 which I dont want to do as I wont be ready to leave then.

Going to the states while in the process will not delay or deny anything

So sorry to make you worry

It does happen, but very rarely. Providing your fiance isn't trying to circumvent the VWP rules and coming in and out of the US often, I wouldn't worry about it. I'm most of the way through the fiance visa process and recently was in the US. Although the POE officer was very curt, it was no problem getting in and although I had evidence with me (rental contract, return flight details, letter from employer, tickets to future events in the UK) I didn't need any of them.

He'll be fine I'm sure!

I am also heading to America for the holidays and I will also have a return airplane ticket and a letter from my employer saying that I will be back at work - Thanks for the hint of putting a date of the end of the vacation on the letter ... even though it was not intended as a hint I think.

I am flying out on the 28th of November (I have been lucky enought to get 5 weeks vacation from my work) If anyone fly out before that please let us know you had any problems and what questions were asked. It will not stop us from worrying, but at least we can worry less.

Good luck to all

Well, I'm flying on the 26th November. I've given up worrying about possibilities of being denied entry. If they want to do it, they’ll find a way and an excuse. But I'm planning on taking as many documents as possible to show that I plan to come back (this time anyway :) ) as well as my airport parking receipt. Surely they’ll recognise that no sane person would leave their car parked at the airport if they didn't plan on returning. :innocent: I'll let you all know if I have any problems getting in but I doubt. Positive thinking an all that....

I entered the US twice during the I129F wait, and had no trouble at all when I entered. I dont think my case was even on teh system,a s they seemed to have no idea of it. I have always said that I was visiting friends and family, and never mentioned my fiance. This could just make them suspicious that you are going to marry early. I have heard many VJ members giving this advise, too.

Taking proof of your ties back home will help though. I am not sure how old you are, but if you are young, then you should also take proof of funds for the trip. This has nothing to do with the K1 process, but purely that they suspect you might find unauthorised work while you are there, especially if you are going for a long time. They always ask me how much money I have with me, and I have a bank statement printed just in case.

My fiance is 19 and he will have about 1000$ - he will be staying with my family and they don't expect him to pay rent so hopefully this shouldn't be a problem! I'm glad you recommended the bank statement, not a bad idea! He also has the ownership forms for his car (should help right? Can't sell it without them!) And a return ticket. He has visited 3 times already this year and has gone back on time each time, so that should be good right?

I have just returned from spending 2weeks with Rob , previously i was over with him a mere 6weeks prior to that! I was worried that constant visits would raise a red flag (not worried enough not to attempt it though!haha)

I was asked no questions, only asked to show my return ticket. If asked about the visa application i would have been honest but i would definately NOT consider volunteering the information.

I am flying back for the Christmas holidays so hoping it is all plain sailing again!

Hope everyone is as lucky as i've been with immigration officers on my visits.
