Getting SSN before or after marraige?

Timeline

I'm wondering if it matters if your wife gets her SSN before or after the wedding. A SSN is not require in my state.

I would advice to get SSN after the wedding so that your wife can use her married name and she would not be having a hassle in changing names.

Thanks for asking that, Buksol. I keep seeing Charles post "mbc" and have no clue what it means. Can't even find it on a google search. Unless he means Missouri Baptist Convention, of course. :innocent:

I waited and applied for my SSN following our marriage. Some people have had problems, some have not. Seems to depend on the office and how well you've done your research. Just don't forget to do it within 76 days of her POE or she will have to wait for her EAD or greencard.

It shouldn't matter, but people seem to have less hassles if they apply in the maiden name before or after getting married and keeping quiet if there are married. The most important thing is that you submit the application and your status is verified before you have been here 76 days.

If you apply after getting married and they give you a hassle ask to see the office manager and tell him or her to read POMS section RM 00203.500 C1 and where does it say getting married affects K-1 status.

I just noticed you mentioned within 76 days of POE. My Fiancee arrived Sept 19th 2008 and we are to be married Nov 19, 2008 60 days after her POE. With waiting for the marriage license to be certified maybe it would put us past the 76 days. Maybe we should just go get the SSN before the wedding? But we dont expect her to be working until after the winter here in Wisconsin.

Any ideas??

I would say you waited maybe 44 days too long already. I would apply ASAP and worry about the name change once she has the SSN and you are married.

The name can be changed on the SSN record after 76th day, just that a card will not be issued without an EAD card or I-551 stamp or card.

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change (e.g., a name change).

If the alien provides documentation supporting the change, process the SS-5 to update the Numident information but suppress the issuance of a card. (suppress issuance of the card.)

Once the name has been corrected she can ask for an SSN Verification Printout, which will show her married name and SSN. This will give her some proof until she is eligible to be issued a card in the married name. She will only need to apply for a replacement card once she has proof of employment authorization.

C. Policy - Employment Authorization by Class of AdmissionThe following policy applies to employment authorization by class of admission:

1. Aliens Work Authorized Without Specific DHS Authorization

The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

If you look at the chart in Section C.1 , the K1 is listed.

2. Aliens Who Require an EAD from DHS Authorizing Employment

The following lists nonimmigrants, by alien class of admission, who are authorized to work only with authorization from DHS. Employment authorization for these aliens must be shown on an EAD.

Looking at the chart for Section C.2 above, you will find K2, K3, K4.

So a K1 can get a SSN prior to getting EAD based on this document from the Social Security Administration. But you only have until day 76 of your 90 day K1 visa to do it.

Just arrived home from SS office and we have applied for the SSN. We had a small problem at first because the lady said my fiancee couldnt get a SSN because she didnt have work authorization. I showed her the copy of the menu from VJ and she still wasnt going to do it. I said we'll need to talk to a supervisor and she ask the supervisor who knew the correct procedure. It was the ladies first K-1.

So now we await the arrival of her SSN.

I hope others will learn from this that when the Service Rep doesn't know the correct procedure, ask for a manager. 9 times out of 10 if you are right the manager will correct the Service Rep.
