Hi, people will probably remember me as arwensun1965, but my name is Janice or just plain ole Jan, well ive been living in America with my husband and eldest daughter, I am terribly homesick and would like to go back home, I have promised Jon my husband that I will give it another year here, but I would like to get my ducks in a row now sort of thing.

If and ( this is a big if) Jon decided that he would like to come back to England with us what do we have to do concerning the British Embassy? I know we have to fill in forms and stuff but do I have to be in England for this to happen? Do I have to have a Job and home first or can we look for property to rent and then apply??

Secondly if we decided to get divorced do i just get on a plane and go back to England, Jon and I would like to remain friends no matter what happens, everything is still in the air and we still have a lot of talking to do.

If anyone has any sound advice I would be very thankful

No, you can apply for the British spousal visa from the US. Current processing time is about 20 days (they're backlogged due to student visas) and it's very easy. You know we've done this before, so we're pretty well versed in both sides of the process.

I hope you and Jon can work it out. Maybe trying it over in England will be what makes things better?

I believe Jon and I will work things through, we are a unique couple as we really do love each other and no matter what happens we will always remain friends, we have a situation as consenting adults we would like to know and figure out our options, divorce was just on option, it is not the final answer. We will continue to talk and talk blimey I know how to talk lol.

I love America but at this moment in time I just think it is not for me, I miss England, I do not know why? I have no friends there, no house as I gave that up along with everything else when I came here. I would have to start all over again and at 42 years old it just seems like things are impossible. Money is a big factor, like a lot of people we do not have a lot spare. I am coping as best I can but it is difficult.

Would you be able to stick it out in America long enough to get US citizenship? You can apply three years from your original entry on the immigrant visa and I think it take several months from application. If you have any children together who are also USCs, I would very strongly recommend that you stick it out. Otherwise, it's not such a big deal. It's just that if you go before you have citizenship and then later wanted to return to America to work and live, you'd have to go through the visa application process again.

Thankfully the application process for a British spousal visa is much much shorter and easier. The only trouble is that you now have to be able to support yourselves rather than being able to have help from family members like you used to - so you probably would have to go ahead of him and work a little bit (just secure a job and be able to show the contract would be enough really) before applying if you don't have property or assets.

If you do return to England without him, there's nothing extra you need to do beyond the divorce if you do not have desire to keep ties with America beyond just being able to visit on the visa wavier programme.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

As I said we are looking at all options, is the American Citizen thing three years from when we entered on a CR1 or three years from when we married, this is all a little confusing to me.

Hi Janice! Nice to see you here again. The three years is from your date of entry on the CR1. I can't remember when your POE was, so I can't give you an approximate date for when you can apply, but the window opens 90 days before the 3rd anniversary of when you activated the CR1. Hope this helps!
