Here is a superdificult situation

Totally agree with Lal. Lawyer is not supposed to give an advice to go lie about your status. If it is found out, he can get his license canceled. Regardless of lawyer being right of wrong about advice, this guy was on the wrong side from the beginning. If you do wrong at any point in time in life, it comes back to haunt you at some point in life. Lying under oath .. perjury. Thats a serious problem.

Now solution:

This guy needs to consult with a competent, good, unfortunately costly lawyer IMMEDIATELY. If he gets deported he might not have any chance ever to come back to US so first he needs to have his deportation stopped. This would definitely go to immigration court, probably a few appeals too if it has any chance of getting something out of this, even if there is a humanitarian case. Unfortunately, this is going to be quite expensive. That is the only solution I see at this point.

My sister in law lives with a guy from Jamaica.

He came here 10 years ago to study.

After a while, he made an agreement with a us citizen girl to get married so he can file for adjustment as married to a us citizen.

They got married in 2004, and in 2005 he got his temporary GC.

In 2006 he met my husband's sister and they started living together.

They now have a doughter together, but he never got divorced from that other girl.

Meanwhile, he applied for the citizenship. By preparing him for the interview, his lawyer advised him to tell the whole truth, to admit that the marriage thing wasn't genuine and everything was to get the legal presence in the US. Eventhough, his legal wife is willing to help now, there's nothing to be changed, cause he did tell all the truth.

So, now, obviously he recieved a letter stating that he's now officialy a subject for deportation, and he cannot continue to work or do anything.

My sister in law is desperate. They have a little girl together and he is actiolly a good family-man.

My question is if he divorces that girl within the next 30 days and get married to my sister in law, and they make the paternity test to proove that they have a child together and proove they have been living together for 2 years, can that help, or he's definatelly going to be deported?

are you freakin crazy for aksin for help here?? all of us here have waited for a long time and spent alot of money to help get our spouces here the LEGAL way. and now you want people here to help advise your in laws how to get out of a mess because he commited FRAUD!! he is the reason its so diffucult for people tring to do it the right way. i say deport him and put a 10 or 20 year ban on him too. if he wants to be with your sister in law and his child im sure it would be pretty easy for them to immagrate to jamacia. its NO ones fault but HIS OWN FAULT that he in that mess...

holy #######, i said something VERY similiar to this on a post a few weeks ago. and the VJ gangsters came out in full force to attack me. and now for some reason a lot of people agree with it, even some of the gangsters. this place is really focked up !!!!..

do I care about him ? hell no !! but I feel awful for the child involved, and that would be enough for me to help if I could. maybe more people should start thinking about the child here. so what if the father stays here in the USA. this place is sinking like the titanic anyway.

All right, let me chime in here being that I am an immigrant (Jamaica) and also a USC. We just went through and interview with my hubby in June of this year at the embassy it Jamaica and if you like please read my review. Sorry, babes, but your friend knew what he was doing from the beginning. I have no pity for people who enter in marriages like these, because they make it DIFFICULT for everyone else who wants to do it the right way. I'm the USC, but I was questioned as if I was the benificary at my fiance's interview. Sad to say, but I've seen so many Jamaicans in the same situation and it truly irritates me. I was DRILLED at my fiance's interview (to this day I don't know why). So, if you're able to print this out for him give him this piece of advice.

You said he's a good family man, tell im fi tek im pickney and im ooman n go back to Jamaica. He left 10 years ago, alot has changed in Jamaica. While I don't know what area he's from. If he's facing deportation like you said, tell him to leave voluntarily, he may be able to come back in 10 years or so, if his USC born child can file for him. I have friends that have done so. I hope he doesn't face a lifetime ban.

If you think I'm being harsh, I'm not. I'm so sick of marriages like these. It just makes it so difficult for everyone else.

I am suprised at those who are blaming the lawyer.

I totally agree with you, it's not the lawyers fault. The man committed fraud and now faces the consecuences. Paternity tests won't help his case what so ever, he has a serious legal issue. US law is clear about visa fraud, he should have thought this over before jumping in a very DEEP pool.

I'm sorry for the child. But what ever he gets from the law he deserves every single bit of it, that also goes to the USC that married him.

People have to do things the RIGHT way or with the RIGHT intent.

Don't let the choices chose you, chose the choices that you want.

Paying massive fees for university, bills, food and so on! he saw an opportunity and went for it! that was all done in the past. I have one thing to say, none of these people who left posts on this thread are immigration experts but only have limited and narrow knowledge on immigration policies. The best thing today, is to tell him to hire a very good lawyer and spend some cash! all the best

Don't have to be an expert, but have many friends who have gone through the same thing and have spent $$$$ on good lawyers only to end up losing in "immigration court"

Well I'm not judging him for what he did. It's easy to look at other people and their faults.

The problem is that he didn't know better and took such awful advice from someone who is paid to know better.

At this point there really is no foreseeable way out of this even with a lawyer. There's a reason there's a disclaimer when signing USCIS forms and taking an oath. Given that he has admitted to fraud (was this in writing as well?) there's really no viable recourse. I feel for the child in this situation but the parents made this decision.

Hearbreaking yes, but the fact of the matter remains that this man not only committed fraud, but then went on to commit the epitome of stupidity by admitting to it. Why in the he!! would one admit to committing a crime without knowing what the consequences of such admission will be??? Honestly, the lawyer exhibited incompetency, but where was your sister's man's brain? Having a lawyer advise him "to tell the whole truth" about how he got his initial residency, had to have sounded like bad advice, especially in light of what he was trying to achieve, citizenship! I'm sorry, but his really is a little more than just "I followed bad advice"....more like "I followed bad advice because I was too dumb to question that advice and get a second opinion."

Oddly enough, perhaps that very stupidity may offer him a chance so save himself. I may be reaching at straws here, but if throughout his citizenship process he was represented by counsel (lawyer) could there be a case made now for something along the lines of inadequacy of that counsel? It is definitely time for retaining a very qualified (and as another member pointed out, very expensive) attorney, but maybe....just maybe there might be something that can be done.

Alternatively, your sister should definitely look into options for living either in her man's home country, or a third country, because if nothing can be done and he must leave, there will likely be a lengthy, if not permanent, ban which will prevent him from re-entering this country.

Not to jump on the band wagon but OMG! What was he thinking? 1st off entering into marriage with fraud in mind, THEN ACTUALLY ADMITTING IT? Holy SHlT....

A lawyer ain't gonna help! He messed up on this one, and unfortunatly for the "family" your SIL is not in a good position. Its take gonna take A LOT of Money and an extremely talented lawyer to even attempt to get out of this.

Oh and BTW he will be banned from the US, I know this for a fact!

Jeez, I am trying not to be pissed at idiots like him. BUT I AM PISSED! No wonder immigration is so dificult, people like him make it that way.

Ok done ranting...Let us know what happens. Very curious to see how F'D up the Immigration in the country is (meaning if he actually gets to stay after admitting visa fraud)

No. The thing is your brother in law committed fraud and screwed himself up. Don't put his initial dishonesty as the lawyer's fault. He needs to own up to the ####### he pulled. No sympathy at all.

the attourney is bound by his commitment to the court to advise his client to tell the truth. his client is then given the opportunity to either tell the truth, or to lie. the attourney may not reveal what he has been told in confidence without the client's permission.

sounds to me like the client is an idiot, and the attourney is tired of watching scammers get away with fraud.

I agree with the first part whole-heartedly. But if the second part is true, you are saying he intentionally gave him this advice because it would result in him being banned. If that's the case, the lawyer is guilty of malpractice and should have his license suspended or be disbarred. Aside from the morality issue (about committing visa fraud), he is bound to represent his client's best interests, whether right or wrong. HE DID NOT! If he had a problem with respresenting this guy, he should have quit. (But then he goesn't get paid.)

i didn't come here overnight neither!

i have nothing against you. i meant you should not be asking for help for your BIL. YOU should feel the same to him as well. if i had in laws i knew that were commitng visa fraud i would NOT help them overcome it. i feel sad for the child invovled, but he broke the LAW. tons of people go to prison EVERYDAY and never see there children again for a long time. do i feel sorry for them? NO. if you break the law you should be punished!! PERIOD! its your BIL and SIL fault for bringing a child into the situation, now THEY have to deal with it. they might as well kiss him goodbye now, he already confessed. if someone admits they commited murder do you think they will say, "ok since you told us about we will let you stay in the free world and live you life happliy ever after" ? think about it.....

Can you post the name of the lawyer and address so that we can post it on the internet.. so that even a stupid dumb person would never go to that lawyer.

Again, you need a talented.. extremely competent lawyer. I have seen some of the very difficult cases go through. Even if you do lose, you might get some relief in terms of bans, that you don't get a lifetime ban.

Shusterman.. Rajiv Khanna.. are some to look up.. swanson-n-swanson.com.. they were the former adjudicators in uscis..

If its so hard to be here on a students visa, then maybe they shouldnt be here at all and go to school in their own country.

And he saw an opportunity and took it???? #######??

Maybe people see opportunity every day in robbing banks since there's so much money in them and its so hard here. I would assume most theft cases are the criminal saw "opportunity" and took it.

This guy will get deported because he broke the law, plain and simple. I do feel bad for the SIL and child, but he caused this mess.

And i find it interesting that the one person siding with the visa fraud violator is from Morocco, another high fraud country. what is the mindset there???
