I-94 and K-3 expire in three months

I-94 and K-3 expire Dec 15 2008

Sending AOS package on 9/30

Plan to travel out of the country from 11/25-1/25.

I am assuming I will get receipt of AOS application and biometrics before I leave on 11/25, and the interview will be sometime in Feb-April 2009.

The question I have is - "What documentation will I need to get back int he country on 1/25/2008, since my K-3 and I-94 will be expired. Will a NOA of the AOS package rececived be sufficient? Would I need another document, such as an advance parole document? or travel (I-131) doc?

I'm pretty sure K3 visas are good for two years and an AP document is not needed for sure. All you will have to show is your passport with your visa.

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Normally, but the OP's K-3 & I-94 expire in December and wants to come back in January (1 month after the two year expiration).

So, in this case, do I file the AP before, after or in conjunction with AOS? Filing AP might take too long, and I worry that I would need to wait until I receive my GC

If I decide to adapt my travel plans and travel now, can I schedule to return a few days before my I-94/K-3 expiration date?

Probably a good time to consult a lawyer, but I do greatly appreciate your attention and consideration
