Waiting for SSN??

Just wanted to post this out in the open, so everyone who is waiting for their SSN in the mail, can see this.

If you have your EAD, and it says you can legally work. Then while you wait for your SNN number you can take on a job. I went and applied for my SSN number and he told me the exact same thing, that it could take up to 4 weeks for it to be mailed out to me, because USCIS had not entered it into their system yet. But at the end of tha appointment he handed me a piece of paper, that stated this.

"If you are not a U.S. Citizen and you are applying for a Social Security Number card for employment purposes, and your immigration status allows you to work, you may legally begin employment while you await the issuance of a Social Security Card....."

So I take this to mean that I could go out and get a job tomorow, even without my SSN in hand. And just tell the employer, that you are allowed to work, and able to work without the SSN number in your hand. That you will provide them the SNN as soon as you recieve it.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

Unfortunately many/most employers will be reluctant/unable to do so without some sort of taxpayer ID number (be it SSN or ITIN).

ITIN won't work in lieu of a SSN....

To help ensure that only those who should receive a number do so, Social Security has taken extra steps to ensure the integrity of Social Security numbers. The changes to the way Social Security assigns numbers and issues cards may cause a delay of several weeks or months in receiving a number. This fact sheet addresses employer responsibilities when hiring foreign workers (e.g., students or cultural exchange visitors) who have applied for and are waiting to receive a Social Security number and card. Note that the employee may work while the Social Security number application is being processed.

1. What causes delays when foreign workers apply for Social Security numbers?

When foreign workers apply for Social Security numbers, Social Security verifies their documents directly with the Department of Homeland Security (DHS). Most applications are verified immediately, but there can be delays. Social Security understands that this process may affect companies who hire foreign workers, but direct verification from DHS is vital to ensuring the integrity of the Social Security number.

2. What are an employer's responsibilities when hiring foreign workers who don't have Social Security numbers?

Advise workers that they are required to apply for a Social Security number and card. If a worker applied for but has not yet received a Social Security number, you should get the following information as complete as possible: The worker's full name, address, date of birth, place of birth, father's full name, mother's full maiden name, gender and the date he or she applied for a Social Security number.

3. What if the worker doesn't have a Social Security number when wage reports (Forms W-2) are due to Social Security?

Paper Filers: If the worker applied for a card but didn't receive the number in time for filing, enter "Applied For" in Box a. (Reference: IRS Instructions for Forms W-2/W-3, www.irs.gov/instructions/iw2w3/index.html)

Electronic Filers: If the worker applied for a card but didn't receive the number in time for filing, enter all zeros in the field for the Social Security number. (Reference: Specifications for Filing Forms W-2 Electronically)

Remember to instruct the worker to tell you the number and the exact name printed on the card, when he or she receives it.

4. My foreign worker received his or her Social Security number after I filed my wage report. What do I do?

When you receive the worker's Social Security number, file Form W-2c (Corrected Wage and Tax Statement), to show the worker's number. Go to www.ssa.gov/employer/how.htm#how for instructions on filing W-2c’s.

It only takes an overnight to generate the SSN in SSA's system. Basically, the next business day you can go back to the same SSA Office and request for a printed certification of your SSN. This is what I did. The same day I got the printed certification, I went for job hunting. The 2-4 weeks wait is only for the paper/card copy of the SSN.

It only takes an overnight to generate the SSN in SSA's system. Basically, the next business day you can go back to the same SSA Office and request for a printed certification of your SSN. This is what I did. The same day I got the printed certification, I went for job hunting. The 2-4 weeks wait is only for the paper/card copy of the SSN.

The 2 to 4 weeks is the estimated time to verify the immigration status. Then another 14 days after the number has been assigned to receive the card. You are correct that after the number has been assign that you can go back to the SSA office normally the next day to find out the number and you can request an SSN Verification Printout to give you some proof until you receive the card.

Does it really take that long? anyone of you if going to SSA to check if I am already in the system will help? since the office is just around my block....

You need to find out at which step of the verification process it's at.

First find out why the initial verification failed. Your name can be one letter off and still be acceptable and if it verifies in your maiden name and you are applying with the married name, that's OK too.

Then find out if the SSA office submitted a secondary electronic verification request and if yes, did it come back. If the response was to submit a copy of your immigration documents, were they sent with Form G-845 and when was it sent. If it was sent over a month ago, have they followed up.

The verification can take anywhere from a few days to months.

I assume what she did was the secondary electronic verification? how long does the secondary verification usually take? she used the name that is printed in my EAD. so i guess there shouldnt be any confusion with my name or spelling... Am i right?

It sounds like the secondary electronic verification needs to be submitted. Those are normally respond to by immigration in around a week. The thing is did the person submit it right away and will they keep checking to see if they have received a response and not let it sit. Without looking at the response from the intial verification request it's hard to say if there is a name mismatch. Just because it's right on the card doesn't mean it can't be wrong on the verification response. The good thing is you have an EAD card that's good for a year, so not much chance of you status expiring before it is verified, like happens to K-1s.

Yes best to go back to the SSA office at least once a week to see what's going on. It can take months because the response from the secondary electronic can be that immigration wants to see a copy of your EAD card and that gets mailed to immigration with Form G-845 and immigration mails the response back. There are only 5 or 6 immigration offices that process the G-845s. A lot of them go to the LA, California office for verification. OMG!!! the system suxxxxx... but once you're granted with EAD for sure USCIS will send info to SSA right? so regardless of the electronic verification or paper verification they should send my info to SSA no matter what... and I should be with SSA's system in 10 days atleast. and they should give me the ssn once im in the system even without the response of USCIS right? so going to local office will make a difference. There's no way that i'll wait for USCIS to respond... My info should be sent soon to SSA...

I'll say it one more time, you are not going to be assigned an SSN until SSA can verify your having work authorized status. The fact that you have an EAD doesn't mean anything when it comes to the amount of time that's going to take.
