I got visa K1 to US in May 2008. I came there, stayed with my fiance two and half months but we had some problem with our relationship so we didnt get married. In the end i bought ticket to go back VietNam.

Now problem was solved, we are still in love and my fiance wants to apply paperwork for me again. He'd rather apply fiance visa than marriage because K1 faster and he dont have to deal with vietnamese govement to get marriage certificate.

So, we dont know what should we apply for this time because someone said marriage makes sure to get a visa more than fiance. I dont know how !

Anyone has the same case like me? Please give me an advice. Many thanks !

Jan.10,2010- Notice receipt from USCIS

Jan.13,2010- check has been cashed

Jan.14,2010- NOA1 received (hard copy)

Jan.23,2010- Biometrics Appt.received in the mail dated Jan.14,2010

Feb. 1, 2010- Biometrics appointment at 8a.m.

Feb.9,2010 - touched

March 2,2010- AP approved

March 9,2010- Hard copy received

March 12, 2010- I-485 receipt notice for interview

March 18,2010- received letter for initial interview

April 19, 2010- 8 :15 A.M INTERVIEW DATE ( APPROVED 5min.Interview)

APRIL 20, 2010- USCIS website updated card production ordered

Are you legally married? You wrote that you didn't get married but your writing was confusing towards the end.

If you are, then you cannot file for a K1 visa...a K1 is for NON married foreigners coming into the U.S. to marry their USC Fiance.

If you are married you will need to file for a spousal visa.

Just because the K1 is faster doesn't mean you should break the rules. You will be denied if you are already married.

If you are not married then you can file for another K1 and wait. You may need a waiver.

Since you have already had a rocky road, it seems like your relationship will end in divorce.

If your having issues before marriage, I promise you will have many more after marriage.

Both of you need to move on, and find other people.

We didnt get married yet. We are going to apply paperwork again but we're confusing what kind of visa is better for this time, fiance or spouse visa.

To write a waiver, do we need to explain every detail why the first K1 didnt work out or it should be brief ?

hey,i know some people that filed for K1 visa twice,and they were fine. so don't you worry about it.just do what you have to do like the first time. as long as u left the states before visa expired last time you are fine to file for K1 visa again.
