My stupid RFE: Filled out I-864 for my Minor Child

What i learned and may be others after me: Fill out and submit I-864w for your child if he/she is younger than 18 years. They become a US citizen no sooner they enter the county. becasue of that , USC children, whether biological or Adopted, do not need AOS support. They are exempt from this since 2000 when Child Citizenship Act of 2000 went into effect.

BTW, here is the law:

A child who is:

◦Born to a U.S. citizen who did not live in (or come to) the United States for therequired period of time prior to the child's birth, or

◦Born to one U.S. citizen parent and one alien parent or two alien parents who naturalize after the child's birth, or

◦Adopted (stepchildren cannot derive or acquire citizenship through their stepparents) and is permanently residing in the United States can become a U.S. citizen by action of law on the date on which all of the following requirements have been met:

■The child was lawfully admitted for permanent residence*; and

■Either parent was a United States citizen by birth or naturalization**; and

■The child was still under 18 years of age; and

■The child was not married; and

■The child was the parent's legitimate child or was legitimated by the parent before the child's 16th birthday (children born out of wedlock who were not legitimated before their 16th birthday do not derive United States citizenship through their father); and

■If adopted, the child met the requirements of section 101(B)(1)(E) or (F) of the Immigration and Nationality Act (INA) and has had a full and final adoption; and

■The child was residing in the United States in the legal custody of the U.S. citizen parent (this includes joint custody); and

■The child was residing in the United States in the physical custody of the U.S. citizen parent.

My stupid RFE was:

(1) Co-sponsor's household is 2. NVC claims it should be 3 because of co-sponsor being married.

(2) NVC says my country of domicile was not listed.

What I learned:

(1) To highlight part in cover letter and on AOS package that co-sponsor's husband is deceased. :bonk:

(2) To bold every answer.

RFE : Asking for a marriage certificate

This has been sent and double checked many times when we sent our I-130 package.

Conclusion : They lost it when they forwarded the case or something.

We have learnt : They can be so damn careless :angry:

Feb. 2007 : meet online

March 2008 : Fell in love

May 2008 : officially "dating"

June 21st 2008 : ingame "wedding" haha

August 30th : graduated - on the way to tech school :)

October 30th : graduated tech school - moving base :)

Dec. 23rd 2008 : 1st visit - bf arrival in France (yesss !)

Dec. 28th 2008 : introduced him to parents (they love him, wheee !)

Jan. 4th 2008 : bf gotta go back to the US, sad day.

May 9th 2009 : Civil Union :)

i got an RFE asking for my husbands (USCs) original birth certificate at the I864 stage as they wanted proof he is related to his father, who is living with him and is our co sponsor on the I864A.

i sent it back to them via international express mail, as it was over in australia with me (ARGH) and they received it just on friday the 16th.. SOOO fingers crossed they dont give me any more RFEs and i now can move on to case complete!

Stupid RFE: For India, apparently you have to submit 2 police clearances. One from the District Police and one from the passport office. Especially for New Delhi, you have to have it for NVC, but other embassies in India, such as Mumbai, you can submit at your interview. We only submitted the district PCC.

Stupid RFE: NVC says husband's military certificate needs to be from Ministry of War, but that name is no longer used.

The Egyptian military is now Ministry of Defense, which issues all military certificates. NVC has outdated information, saying that it should be Ministry of WAR, but that name changed over 5 years ago!!!!!!!

I don't understand why only we are getting this RFE, or are ALL Egyptian petitions getting this RFE?????? I've talked with others from Egypt who have not gotten this RFE............ :bonk:

Stupid RFE: court records from a TRAFFIC stop.

If it shows on the PCC, no matter how trivial you think it is, get certified copies of the court records, because the NVC will want them.

Stupid RFE: Marriage certificate stated that it was issued by the "Demographic Service" in Italy instead of "vital statistics office".

USCIS reciprocity tables states the marriage certificate should come from the vital statistics office. The marriage certificate also did not have the exact words "Marriage Certificate" on the document we were given right after our marriage. So USCIS was stating that they did not know if it was a marriage certificate or not.

:unsure: solution:

We obtained a letter from the Demographic Service which stated that it was under the umbrella of the vital statistics office.

For the marriage certificate issue we simply requested another copy of the exact same document which was sent to USCIS originally with the petition. Except, this one was labeled "Marriage Certificate".

This RFE cost us about 4 weeks in delay, but the petition was approved shortly after the documents were received by USCIS.

I only sent in the "Certified" english copy of my husband's birth certificate. My husband said that would be enough.

NOT!

What I learned:

When they said they want the ORIGINAL birth certificate with the english translated copy even if it was CERTIFIED, SEND IT IN!

my rfe: regarding places i lived,a gap more than 6 months occur....etc

what i learnt: write the addresses from the most recent till your past since you were 16,check the dates and years twice or more:) and keep a copy before sending to abate your doubts

I got an RFE that I have to send in the Original Birth Certificate instead of the copy

but I sent in the original to uscis and never got it back but I had copies of it

Now the birth certificate I used is the new computer generated one, which my wife would have to go get a new one that could take weeks

she has the original hand written one that was made out when she was born in 1987

you think I can send in the hand written one now, would it be a problem?

Yes I got an RFE for not submitting passport PCC So I went and collected the PCC from passport office and sent to NVC. I did send the local PCC. When I called NVC to check the status, they said it was a mistake of raising an RFE and case will be closed and transferred to Chennai consulate. Anyway since i sent the document, the status is showing as pending as they received the packet and pending "processing". So far I lost more than 2 weeks because of this. Hope they will process and close the case in another few days.

I got a STUPID RFE. They say they need the Original Marrige Certificate in Arabic, BUT i sent it. i made sure i sent it. and cliped together and I wrote the Case number on everything. But good thing i had another one. so im sending it tomarrow morning.

12-01-10: Embassy Calls Husband To Send In Passport Finally After Almost 9 months Of AP!!
