Hello Everyone. I'm new to this thread. I sent out my I-130 on 9/24 (rcvd 9/26) for my husband in the Philippines. It's being processed in the NSC. On 11/4, I got an alert that my status changed for an RFE. ughhhhhh

It's been a little over a week but I haven't got the notice in the mail over what it even is about. Tried to call them to see if they can just tell me over the phone what they needed. Turns out they can't.

I really hope it's something super simple.

You should have waited to see what the RFE was before posting.

From there, you would have determined whether it was a "stupid RFE".

I actually got the RFE in the mail today, and it wants me to send an NSO/PSA copy of my marriage cert. even though I sent them the original one. Supposedly, it's because the original from the city hall did not contain a seal. But it did, it was just perforated and not foiled and thus will not show up on a photocopy. The Philippine offices of NSA/PSA do not allow access to the certificates until 3 months later.

Can I now determine that this is a "stupid RFE" and therefore have the right post something in this thread?

09/24 - Sent out I-130 to Phoenix, AZ

09/26 - Received at Phoenix (somewhere in between, the I-797 was mailed and marked back to sender due to post office error)

10/24 - Finally got the I-797 NOA-1 resent to me - forwarded my case to NSC

11/04 - Status changed to RFE

11/12 - Got the RFE letter in the mail (certified copy of marriage certificate)

11/18 - Mailed in RFE response

11/21 - RFE received at USCIS

11/21 - RFE status changed to response review

11/29 - Case approved at USCIS

12/03 - Received NOA-2 in the mail

12/09 - Case sent to NVC

12/15 - Case received by NVC

12/20 - NVC case number and IIN assigned

12/21 - DS-261 submitted online & gave email addresses

12/22 - Had NVC review DS-261 over the phone, paid AOS fee

12/24 - Paid IV fee

12/28 - Submitted DS-260

12/29 - Submitted packet to NVC via FedEx

01/03 - Packet delivered to NVC

01/04 - NVC scan date

03/02 - NVC Supervisor Review

03/16 - Case Complete at NVC

03/30 - Interview date confirmed over phone (and P4 email?)

03/30 - P4 letter received via email

05/02 - Interview at Manila Embassy

Timeline

Stupid RFE I received Jan 14th. Proof of divorce (I do believe dissolution is different somehow?) 

 

I immediately checked over the copy of the packet I sent them. There was a document. Dissolution of marriage with a judges signature on page 8 of 9. I begin feeling very confused here. I start googling divorce decree and final judgements. It seems like this should have been what USCIS needed. So I determine the best course of action would be to check with the courts. (I had the documents emailed to me from the clerks) 

 

I went to the court office before I called and inquired about the document needed.  I got a new divorce degree/final judgement , stamped and certified. The clerk said this is the most official document you can get and there is no other file they have.  This was the same damn document I submitted originally! 

 

I give USCIS a call as I am in complete disbelief. I asked them if this is the correct document as I had already submitted it. The reply was  " Yes , well they may ask for another document of the same for comparison. " I asked what are they going to compare it with as it is the exact file the court office gave me previously. She said she cant answer that and just submit the file. There is nothing more to do , it is in the officers hands. 

 

I will send the file in today, but boy is this crazy, frustrating and confusing.  The hope is they actually lost it somehow because there is no other form for me to get! 

 

What file did any of you who where divorced send in?

I'm divorced as well and the process has been an nightmare since Mexican laws are so annoying. There is only one document ( official certified copy) that's supposedly you have to send, but I do have the original divorce decree that's signed, just not by us. every country is different, and it seems that sometimes they expect certain papers that just can't be obtained from a specific place.  Hopefully the document you have will be enough and they won't delay your application any longer!

➺ 12/15/17 NOA2 finally! after 10 1/2 months. 

➺ 12/21/17 NVC confirmed they received our file 

➺ 01/22/18 Documents sent to Rapidvisa 

➺ 02/05/18  NVC received our package 

03/15/18 Case complete! 

06/27/18  We got our Interview date! August 28th 

08/30/18 The package arrived (waited at Juarez)

08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

Thanks! Its already at their PO box hopefully they see it by Monday (they didn't work today). I may never know what happened. It is in an officers hands so I am paying it moves quickly.

I got an RFE for the same thing! I sent them the first time and resent as they had asked and still waiting after 50 days! Did you get approved?

what document did you send the first time, was it a copia certificada, was it an original? from what state?

We sent certified copies the first time and they said they didn't receive them and so we resent them. I'm in Oregon. It's so upsetting we are at 56 days and no Word from them!

ugh that's so awful. :( And infuriating. If you sent a full package that means they lost them?  I'm sorry you guys lost 56 days. Is there a way you could get expedite? It does state that if it's USCIS fault, but I'm guessing they won't admit it. Ugh.

Right? We have an attorney and not sure if we can expedite as we also had to file I-212 waiver 😩

Submitted a copy of what I thought to be an original birth certificate to establish my US citizenship as the I-130 petitioner. Turns out, my birth certificate was seen as an abstract, or abbreviated version, and not the true document. In my RFE, it said that I needed to re-send a birth certificate that "is a registered civil authority issued birth certificate that contains the name of the child, date and place of birth, full name(s) of the parent(s), doctor/attendant's name, hospital name, registrar's signature, and the date the certificate was filed with the registrar's office."

 

Lesson learned for me - I wish I had sent my US passport to show my citizenship as petitioner and not my birth certificate. The passport is standardized, and offers less room for error.

Yeah,you always should send the long versions of anything you can.

I sent my birth certificate and passport. I was not leaving room for error.

Married since February 29th 2016 In the Netherlands (Where she is from)

6/12/16 - Preparing to send packet to USCIS

6/27/16 - Sent Package to Chicago lock-box via UPS

7/5/16 - NOA1 Text/Email / sent to Potomac (Hardcopy 7/10/16)

8/3/16 - NOA 2 I-130 Approved! Case sent to NVC! (Hardcopy 8/6/16)

8/19/16 to 9/4/16 - Visited wife for two weeks in NL. =}

9/1/16 - NVC Case and invoice # received. (Email) Finished DS260 and Paid AOS Fee.

9/8/16 - IV Fee Paid!

9/16/16 - DS260 Finished!

9/27/16 - Sent Documents to NVC.

11/21/16 - Called NVC. Case reviewed and accepted on 11/18. Waiting for email/mail.

11/28/16 - Got Email stating we are now waiting for an interview spot!

12/11/16 - Got the interview date! 1/12/17!

1/12/17 - ...ACCEPTED SHE IS NOW WAITING FOR HER PASSPORT IN THE MAIL! =]

1/18/17 - Passport and visa in her hands! We now wait till 2/24 for her to fly to me! (Has to finish work contract)

2/24/17 - She is now here with me! POE was simple,she only took 10 minutes with them checking her visa! "Welcome to America,missus"

3/15/17 - SSN Card Received.

4/10/17 - Greencard Received.

 

Preparing I-751 (ROC)

11/26/18 - I-751 Prepared and mailed out.

11/27/18 - UPS Confirmed Delivery at 10:30AM

12/3/18 - Checks cashed and got Email/Text With Receipt #

01/3/19 - Extension letter received.
