Staying ahead of the IMBRA curve - How to get your criminal records?

Recommended Posts

Some forward looking folks are anticipating petitioners will need Federal and/or state criminal records in advance of a possible request for them from our regional SC's. Can those of you who have started getting them or plan to please share websites, emails, phone numbers, etc. from whom they are getting their reports? Associated costs if known would be nice as well!

Has anyone gone ahead and done this yet?

We were married in Washington in August, we submitted our I-485, I130, I765, and I131 in Sept of 06 to the Chicago Lock Box, and got our Green card in January 07!!! Found this was much faster and easier than going through the K1 process.

Has anybody considered how expansive this change is? I can guarantee you that USCIS has their lawyers sifting through the regs looking for all the areas IMBRA has an effect on. Regulation and policy may have to be rewritten. Adjudicators and CO's are going to have to be given new directives. I'm not trying to $hit in anybody's mess kit here, but I would not even BEGIN to try and second-guess what USCIS/DHS is going to require to FIX these petitions that are caught in the crossfire.

I talked to my fiance and we decided not to get the FBI one, but we´ll get the state one ´cus it´s easy and simple. If they come to ask for it, we´re already ahead of them, if not, no problem, it costs only U$1.50 to get one from Puerto Rico, besides, my fiance gets them all the time to present at job interviews.

Google your state´s police department. I can´t give you a link ´cus my fiance is from Puerto Rico, so he´ll just to his, and the fee there is this much, you must look into your police department and see how to proceed.

Please forgive my ignorance as I'm a newbie here and I'm about to mail my first I-129F submission this coming Tuesday, but I'm confused about all this talk of IMBRA. If I understand the threads clearly, has USCIS/DHS taken current and also incoming submissions and put them on some kind of hold, until they decide what kind of changes they need to make to the process? Because, I'm seeing people here getting approved and getting the Visa's. From what I've gathered looking through the numerous member's timelines, most have gotten through the entire process in less than 6 months.

If USCIS/DHS requires additional info - background checks, it is my hunch that they would first have to officially announce it and then designate a date when it goes into effect. All this second guessing and hearsay seems a bit unnerving. Don't get me wrong, I'm grateful that people here are willing to share information but I hope that we're all careful not to spread disinformation or rumor. Just my 2 cents. :help:

Everyone who submited their application after March 6th are having their application either on hold or recalled, if they had already left the Service Center.

As they didn´t release a new form I129F, I think even you´ll have your petition on hold.

It wouldn´t be a bad idea to call them and ask whether you should send your application now or wait.

I really don´t know.

You can submitt your I-129F now but it will be halted after all checks have been done and you´re ready for adjudication, you´ll still be pending the IMBRA requirement.

Well.. it´s said on their proccessing dates that Vermont is now processing petitiobs filed on March 6th.

No one got anything about petitioner´s criminal records yet, but if they update their processing times in 2 weeks as they usually do we can find that out.

I wanted to stay ahead of the game, so I went ahead and ordered my FBI check. I went to my local police department and got my fingerprints taken, as they are required to send in for your FBI check. THe fingerprinting was free and the FBI charges $18 (money order). They say it takes 8 to 10 weeks. I figured what is $18 compared to waiting for 1 month and them requesting this from us, and waiting 8 to 10 more weeks. If they ask for it, I will have it to send in. I aslo did the State Police check. I found their website online, and you just do it online. It cost $10, and you just print it out if you have no record. If you have a record they will mail it to you.

I think this is each individuals call as whether to jump ahead or hold tight. All I know is I can't stand waiting and being without my love, so I am going to do whatever I think will help us as quick as possible.

If the DHS requests a police certificate, it would be likely in the form of an FBI clearance certificate. State police issued certificates are useless since one could have stayed in a number of different states and many states mandates a personal appearance to issue such a certificate. So I would not waste my money on the state certificate. FBI is pretty comprehensive anyway and is similar to the police certificate required of the Fiances from their country of origin.
