Entering the US during application for a K1 visa

Hi,

I wondered if anyone has any experience of entering the United States after submitting a petition for a K1 visa? I'd like to visit (on the VWP) my boyfirend for Christmas, but my boyfriend sent the petition for the visa last week.

You can find more info on that here

It is possible (I entered the US on the VWP post NOA2 after receiving packet 3 but before returning it) but there is no guarantee that you will gain entry (as there never is on the VWP). The main tips are to bring evidence of ties to your home country - rental agreement, letter from employer etc. and to not offer any information to the IO unless they ask for it :)

I've done it now (awaiting NOA2) but had a LOT more questions and concern at the border. I had loads of evidence with me.

I'm hoping to try again at Christmas too for the last time so here's hoping.

My fiance came to the US on July 6 of this year, about 10 days after we got our NOA1. He didn't have any problems coming in through JFK in New York for a 30-day stay. He presented a return ticket to Britain when he arrived and they just basically waved him through (part of this may have been that he was coming from China and not directly from Britain--it may have looked even more like a tourist trip). We expected him to be questioned a little more thoroughly, but luckily we had no problems. Definitely bring lots of evidence!

I already have my flight booked for Christmas and I am waiting for NOA2, I will even delay sending back packet 3 as I should hopefully have it by then

I am going to take a letter from my employer stating I am in full time employment and the date I am going to return, I will have my return flight ticket as well.

Take anything else you have like mortgage or lease

I would not offer it up at POE but if asked you have it, they dont have a record at POE that you have applied for the K1

Go have a great trip, yes there is a small chance of being denied entry but this could happen even if you are not going through the process, and it is worth the risk in my opinion

It really does depend on the officer at POE, i've been lucky each time flying into Raleigh as they're a darn sight more cordial than at other POE's i've been through!

I entered after our NOA1 and had no questions asked at all.

It is always better to go prepared with evidence of your ties to the UK just in case you're asked.

Yes, we did. Twice. No problems, no questions. It's easy when you're old, work for the police, and only plan to stay for 2 weeks. :rofl:

You have to look and act like you are coming on holiday to visit friends. If you come and stay 90 days, go home two weeks, come back for 90 days, over and over then they probably will suspect you are trying to live in the US. If you're just coming for the Christmas holidays, then you're probably fine.
