My case was approved on 8/29- but it still isn't at NVC... what should I do?

My case was approved on 8/29- but it still isn't at NVC... what should I do?

Trying talking to a rep at USCIS...they say it can take anywhere from 90days for your case to reach NVC???....I heard about your email also about getting an RFE....I would definitely call USCIS and find out what is going on by speaking with an operator....

I don't have any advice for finding out what's going on with getting your papers over to NVC, but I do have a few words for you: Congratulations on the approval!! Just a little bit more to go...

I've seen some people here say that it took up to 12 weeks some times. Just gotta keep calling both, the USCIS and the NVC until your petition is safe and sound.

Thanks everyone. Yeah, Jgay- long story short, the NOA1 that I have had this whole time was for someone else's case (I didn't put two and two together when I noticed that my NOA2 had a different case number). But the guy at USCIS was quick to tell me that my case is approved and RFE is associated with someone else's case (which I received the NOA1 for), makes sense, right?! haha.

I may try calling tomorrow about when it gets sent onto NVC.

Congrats first and foremost!

Sometimes with CSC it takes a bit longer to reach NVC - so hang on but start getting ur paperwork in order - it does go fast and godspeed

You need to talk to a supervisor at NVC...YESTERDAY.

You need to send them a copy of your correct NOA2.

You need to stay on top of this, because if you don't it will stay under the carpet.

The NVC has enough work trying to handle the cases they don't screw-up. They are very reluctant to look into cases they have screwed up.

They will not initiate any investigation without you pushing like a pit-bull. As long as you accept their BS, they will continue to feed it to you.

The choice is yours.

Wait- I'm not sure what I need to tell them to fix. I recieved the incorrect NOA1... but the correct NOA2. My case, when I look at it on USCIS website and when I call on the phone has been approved. I don't understand what needs to be fixed.

Unfortunately, someone else's case is likely messed up because I have their NOA1... but I can't do anything to fix that.

I'm confused, if there is something I am missing, please let me know.

You said your case was approved 8/29....your signature indicates NOA2 on 9/6. Whichever date is correct...it should not take that long for your case to be received at NVC.

What you need to correct is...they have somehow misplaced or completely lost your package. You should at a minimum have an NVC case number by now.

Review the link in my signature...it shows what happens to the "average" approved I-130 petition at NVC.

If it was a week or so...I'd say don't worry...but I'd rather tell you to start complaining now, rather than wait 12 weeks to get angry.

This may seem really ridiculous to ask- but how do I get someone to answer to the fact that it has been a month and my case isn't at NVC? I called USCIS and they told me that they can't do anything until it has been 90 days- what do I say then? How can I get someone to look into whether or not my case is missing?

:star: Have you spoken to someone at NVC or are you just going off the recording? My recording at NVC never said my case had been received, and we have already received our paperwork from our consulate. If you have not talked to one of the people at NVC, start there.... :star:

Well, I finally talked to someone at NVC and she was quite rude to me. I explained the situation and all she would say was "well, it can take 90 days to get to us. If you want to know why, call USCIS to see why it takes so long to get here." I couldn't believe how rude she was.

So, I called USCIS and they keep apologizing and telling me that there is nothing they can tell me. I feel so frustrated. Neither one of these offices wants to take responsibility for this case.

Meliss3108, I am sort of in the same situation...but have only waited 2 weeks now. I called NVC today and spoke to a supervisor. The supervisors are very busy but if you continue to push with the operator they will eventually wait until a supervisor is free and forward you to them. I have noticed that NVC gives me different time frames depending on the type of petition. For the I-129F they say that it takes 2-4 weeks. For the I-130 they say that it may take up to 90 days. I would suggest referring to your I-129F petition and tell them that it has been more than 4 weeks. Speak to a supervisor and ask them why your petitions have been misplaced. Tell them that you verified that USCIS has sent the petitions to NVC and ask the supervisor what they will do about it. Be pushy...do not let them off the hook. This would be my advise. Hope it helps. Good Luck....I still have to wait 2 more weeks before NVC will do anything.
