here's the story...

filed ... march 31, 2008

NOA1 ... april 16, 2008

RFE sent ... august 12, 2008

touched ... august 13, 2008

touched ... september 19, 2008

for the record, my fiance never got any notice or RFE in the mail. nothing. and everytime he calls, they keep saying "we already mailed you your RFE. if you dont recieve it, call back in 1 week."

then 30 days passed ... the weekly reply was ... "sir, please wait for it in the mail or call back in a week's time."

and it has been like that since august.

today he called and guess what?

they said our file has been forwarded to the "abandoned case" department. because the petitioner never called or followed up. so it's now marked as abandoned and soon to be a "closed case."

what about all those calls every wednesday when my fiance is off? he never misses a week.

so now another RFE has been sent (duh!)... :bonk:

word of advice... if you talk to someone from the USCIS and they sound asian and can barely speak asian... request for another officer or call back or get their name or make it clear to them that you want your call to be recorded and noted on your file.

no offense. i am asian. but hello? shouldnt USCIS get someone who can speak and understand english well?

my fiance always got answered on the other line by some asian sounding employee of the USCIS that actually sounded like a take-out asian buffet delivery call. gggrrr...

this time he got her name and told her to write down everything they talked about. and to put on record that he called every day off he got. later today, her boss from the USCIS called my fiance back and told him to wait for another RFE on the way... argh.

anyways... vj people... keep calling when your case is pending and make sure they take note of your calls. i never want anyone to be the in the same situation we are. my fiance's bday is next month and we had plans. we have been set back to a month already and possibly another two months in the wait.

good luck all.

p.s. i just checked and now our status is touched september 24, 2008. :help:

There is a reason why we call it the USCIS mis information line. Sorry to hear you were getting the run around. I hope things are back on track soon. I highly doubt that everytime your fiance called the USCIS line that they got a person "they sound asian and can barely speak asian"? They're not required to speak asian as far as I know. If he had trouble understanding the operator due to their accent, he should hang up and call back again, or better yet, tell them he can't understand their English, and ask to be transferred. Take out buffet? That's not very nice.

like i said. no offense.

i am asian. my fiance is asian. but born and raised there.

he said the person on the other line sounded like a take out buffet. he did call again. and again. and again.... and again.

ok. the accent. they did not speak in any asian language.

i typed that wrong. sorry. my bad.

i meant they speak english but with the asian accent which made it hard to understand.

i got a honduran accent every time i called. poor attitude, arrogance, misinformation, poor listening skills, etc, all paid for by my tax dollars.

there really should be a choice for english, spanish, mandarin, etc.

well my fiance knows no other language other than english. but many times he called it was someone with an asian accent and who just kept repeating "sir, we already emailed you the papers" over and over and over again.

and yes... poor listening skills. very true.

My original NOA1 was lost in the mail, so i've called VSC and wanted to get a 2nd NOA1 send to me for my record. The first person answered my call say i should wait about a week and then call back again. So I hung up and called back 1 minute later and reached another person, she said they will send me a replacement copy in the mail ASAP. sure enough, I've received my replacement NOA1 in the mail 3 days later.

When your dollars at work, use every right you have to get it working for you.

for vj member hunnybaby...

hello... first of all, tell your fiance to call during california office hours. just in case he is not from the west coast.

here goes ...

1-800-375-5283

1-800-767-1833

and i dont know if he followed this but one vj member said to dial the hotline and press 2 then press 3. dunno if it works but worth a try.

you are just a month ahead of us regarding the filing date. you should be calling now. i mean your fiance. and tell him to make sure they take note of his calls. my fiance called and called but they claimed he never called. thats why our case was closed.

i hope this doesnt happen to you.

good luck!

I got my NOA2 about 3 weeks ago. My fiance did not get his paperwork yet from the Embassy in Rio, but we decided to go ahead and take care some of the things we could. so we realized that he will need 3 times the Hepatitis B vaccination with a time of 4 months between the first to the last one.

I beleive he will have his interview before the last one. So what could we do?? Could he take the last one once he is here in USA?

Please, let me know. I would appreciate any help.
