Even if we´re not sending it, my fiance will get the state´s police record, he´s done it before for work, it´s fairly simple. My guess is that USCIS will do the FBI one, but since they did mention the petitioner submitting criminal background report, I am guessing the USC will indeed have to do as us, the foreigners have to do, and go get the state´s report. We´ll do it ´cus it´s painless, and if they ask at least we´re ready to send the next minute.

I too would suggest waiting until additional information is requested, before sending anything extra to CIS.

I know this isn't easy. I don't think anybody here is saying it is.

But complaining to elected officials about administrative screwups and chaos on the one hand, and then sending a pile of unsolicited information on the other, doesn't make sense to me.

I am not a practicing attorney. I have a law degree and I passed the bar exam, but am not admitted to practice because I got a job in legal publishing and haven't gotten around to applying for my license yet. Publishing is great, but it does not make you qualified to give legal advice. So I don't. I just want to get married to my fella, which is why I'm here! If you need legal help, seek the advice of a licensed attorney.

I understand the part of not sending if they´re working on different petitons and won´t even know what to do with your stuff. I still say it won´t hurt to have the record ready just in case.

Where do you read they will be requesting formal reports from this? From this statement they will send a questionaire The point is we don't really know what they will require.

I spoke to my lawyer (who is as livid and flabbergasted as the rest of us) and he said getting the background check isn't a bad idea to do now. My father did them for years for the government and he said to just go to your local police station, fill out a form and it'll cost a minimal fee to mail in. Results should be mailed as a certified copy of the background check within a week or two.

Here's the kicker. The IMBRA deal includes a letter from the petitioner stating that they can release your background information to the beneficiary (especially if there is something in there that is questionable such as domestic abuse, sexual offenders, etc.). Therefore, perhaps a letter (that is notarized, making it legal) that the USCIS can reveal your background information to the beneficiary.

It can't hurt to do it...and if anything, at least we'll all have our background checks done by the time they do send out the new form.

7/11/2006 - Received, filled out and overnighted RFE back to the CSC

9/22/2006 - Found out U.S Consulate in Sydney mailed Packet 3 to my lawyer..IN VIRGINIA..and not my fiance. Argh. Lawyer overnighted information to me.

9/25/2006 - Received packet...got together additional forms to send to fiance in Australia

10/12/2006 - Send packet Express to Australia

10/19/2006 - Package finally arrives at Fiance's door. Argh It's taking forever!

11/29/2006 - K-1 Visa Approved!!!

12/17/2006 - He arrived in the states! I'm in shock!

2/24/2007 - Our Wedding Day!

4/14/2007 - Mailed forms for AOS and EAD

5/24/2007 - Biometrics Interview in New Orleans

6/22/2007 - AOS Approved!!

Do we know that they will be requesting criminal checkes on everyone, or just on the people who met through a broker?

This law may be holding things up for everyone right now, but ultimately, it is meant to deal with connections made through marriage brokers, isn't it?

yes, that is what I thought. I guess I hoped there was a way to separate those claims, but I guess that isn't how it works!

Well, I am not against the law. I do wish they had prepared themselves for it a bit better though.

Did you read? The government site says nothing about a report. From what I read they send you a questionaire and you fill it out and most likeley sign it. I challenge you to find documentation stating you will be requested to submit a criminal background "report"

I think everyone needs to remember that NOBODY HERE KNOWS what will actually happen as a result of IMBRA.

When people here argue about whether they will do background checks, request records from petitioners, or ask petitioners to fill out a questionnaire, it's kind of pointless AND gives the (mis)impression of actual direct knowledge.

Nobody here should be speaking with any kind of authority on what will be done with our petitions.

Don't get so desperate for answers that you start making up your own.

"Please forgive my ignorance as I'm a newbie here and I'm about to mail my first I-129F submission this coming Tuesday, but I'm confused about all this talk of IMBRA. If I understand the threads clearly, has USCIS/DHS taken current and also incoming submissions and put them on some kind of hold, until they decide what kind of changes they need to make to the process? Because, I'm seeing people here getting approved and getting the Visa's. From what I've gathered looking through the numerous member's timelines, most have gotten through the entire process in less than 6 months.

If USCIS/DHS requires additional info - background checks, it is my hunch that they would first have to officially announce it and then designate a date when it goes into effect. All this second guessing and hearsay seems a bit unnerving. Don't get me wrong, I'm grateful that people here are willing to share information but I hope that we're all careful not to spread disinformation or rumor. Just my 2 cents."

The above is a quote from another thread. This is part of what worries me about the second guessing being done here.

I would pose this - are those of you who are presently in the IMBRA "black hole" perhaps suggest that those USC's who are about to submit a petition hold off? Are we confusing people doing research to the extent that they will attempt to submit background checks, etc. and other documents that will cause them RFE's.

The potential for impacting other lives here is great.
