Hey Guys,

The embassy said that our marriage papers were wrong but the immigration said they were correct. We are still under investigation for the 3rd time. The last time we did not received any paper telling us to bring or do anything further or a date or time for the return, all we were told is we will be notified but we cannot call them.

My husband come here from the U.S. to talk and help me with the interviews and take me back, but was not able to talk to no one and was told to just sit in the hallway and wait. Now I'm doing all I can to keep his Jar head ### out of the embassy cause he want's to kick some serious ### :bonk: hahahaha. HOORHA!

I hope you don't mind my asking, but what is wrong with your marriage papers or "certificate"? Does it have something to do with your names misspelled or incorrect entries in the certificate? Just curious.

Jan.23,2010- Biometrics Appt.received in the mail dated Jan.14,2010

March 12, 2010- I-485 receipt notice for interview

March 18,2010- received letter for initial interview

Sorry guys for making you all curious, the problem is on the marriage license. First and foremost my husband came here last Feb.14,2008 and got a legal capacity to marry (LCM)Feb 15, 2008 while my aunt went to Civil REgistrar. I have no knowledge about the process of getting a marriage license so my Aunt did all. All my husband and I did is sign all the paperworks that needed to be sign gave our passport, the LCM and fee.

During the interview the Filipina interviewer (she is so kind) asked me if we did a Personal Appearance and i said "No"then she called the LCR (local civil registrar) to fax the ML (marriage license). Then the problems started.. #1. NO PERSONAL APPEARANCE #2 WRONG FILING DATE #3. NOT A RESIDENT OF SAN JUAN #4. FORGERY OF MY SIGNATURE this problem made our marriage questionable.

She asked how we got the ML without having a personal appearance (PA) and i told her my Aunt did all the processing and didn't told us that PA is needed. Then after she told me it appears on the ML that the filing date was Feb.11 knowing that my husband arrived on the 14th and got the LCM plus the LCR wrote an address as my address that i don't even know i just couldn't believe so the interviewer shown me and i told her that i've never been to San Juan i don't even know where is it (I'm from ILoILO) so how can i be a resident of SJ..But what made me upset and shock most was when the interviewer told me the LCR forged my signature then she let me signed in 3 times and she was so right.

she then informed me that the LCR of SJ is into this money making business for a long time esp.once they knw there's a foreigner involve. She said almost of the visa applicants who got their ML from SJ encountered same problem and she said the LCR of SJ will soon to be blacklisted to the uSEM and i should file a case for what they've done.

After the interview done i was transferred to American lady officer and she said why i lied to the US Gov't. i answered her i did not and then told me about the ML thing, esp.my forged signature and so i told her back i didn't know such thing it was my Aunt who processed then she gave me a sworn affidavit, i signed it and all the report papers and it's over. I got no paper. I asked the Filipina interviewer why, she said they will still make a report and review my case. She advised me that it will help me if i see an immigration lawyer while waiting.

We met an immigration lawyer told him about the problems,he said my marriage is valid and didn't see to make it voidable because nowPA is alllowed and the fact that I Bill and I complied all the requirements before the marriage. And the USEM should put all the blame to LCR of SJ once they review my statements. Now all i can do is pray that all things will be okay. :)

hi there sorry for what happened to you but I think there were some technicalities as to application of the marriage license that were not followed that's why they are questioning the validity of your marriage. if things were done right from the start this mess won't happen. don't get me wrong but the fact that your aunt was able to secure a marriage license in a city far from your residence and without personal appearance from you and your fiance could really raised a red flag. maybe the USEM is thinking that your aunt bribe the civil registrar of San Juan so she can get you a marriage license. hiring an immigration lawyer is the best thing to do right now. good luck and I wish you all the best. just hang in there girl. every thing happens for a reason. God bless you and your husband!

and may i just add whatever will be the outcome of your case, i think it's important that next time if you have to deal with similar process again like the AOS, SSN blah blah blah it would be better if you know the process yourself and don't just rely to anybody because if things go wrong you can't just say.....i did not know about it etc.....remember ignorance of the law excuses no one.....God bless you and be positive lang okay....you are in my prayers

Thank you for the reply and yes tama ka ignorance of the law excuses no one so now i'm learning. But we're not giving up. My husband and I are doing all we can to fix the mess with the help of u.s immigration lawyer and if ever the USEM turn us down we already have a plan for us. God is Great and still i'm facing the day with a smile on my face what matters most for me is that my conscience is clean.

Yes you were right, we were thinking of that too. But you know i do believe in Karma.

Console ko na lang to myself i was able to prove the USEM our marriage is not a fixed one and we married because of love.

I think that's the problem because getting married, I think you have to have personal appearance to prove that your marriage is valid...

Oh dear!! Sorry hearing about it. It is really one of the requirements if you apply for a marriage license....:(..So now I understand. ...

Actually, i was asked during my interview if we have a plan to marry again. Yes, we are planning a church wedding but sa US na. I also asked the interviewer pero di nya alam yong tungkol dun.

Securing a marriage license in a place where neither of the parties is a resident is a mere techinicality in your marriage application. It's a matter of jurisdiction I guess. I would advise you to get a lawyer who can help you with this problem.
