We were denied after filing the 129F . The reason given was that she would not return to her country if given a tourist visa. It is the catch 22 they said. Complying with the " strongest ties " rule is tough because her ties are to you if she enters the USA.

I'm confused on why you got denied? I was just wondering like if x-mas rolls around and we still don't have it can he come visit me for it?

I asked the same thing as I want to go see my honey in November. I was told to just have lots of evidence that I have ties to Canada that I would not abandon at this point. Letter from employer stating on authorized leave and expected date of return, a return ticket, copies of my property deeds to show I would not leave that. But in the end its still the agent you get at customs that decide whether you get in or not. GOOD LUCK!

There is no hard rule that your fiance will be denied entry into the US. 129-F applicants do make it into the US on a tourist VISA or VWP. However, the immigration officer at POE might refuse permit if (s)he is not confinced he's not gonna leave the US within 90 days. Chance of one being refused is higher when in application process of 129F since immigration officers are aware of the opportunity of bypassing the procedure by traveling to the US. I recomment you not to take the risk and wait for a few months.

as you can see from the above posts there is no right or wrong answer to your question. But almost everything in life we do carries a degree of an associated risk with it. Even arriving in the USA as a tourist on a VWP, carries a risk of being denied entry. The final decision whether to allow an entry or not always lies with the POE officer, even when you eventually have your K-1 visa. There are no guaranties. We all have a different levels at which some risks are more acceptable to us then others. So, yes, your fiancé can enter the country during K-1 processing but it also carries a higher risk of denial (depending on how he answers his questions ). Personally, I have chosen to take the risk and shall be going to see my baby for Thanksgiving but shall do as Wis-Can said in the previous post (take as many documents as possible to prove my ties to UK with me). For me, I'd rather try and see if I can spend some time with him, even if it's just a week, then being apart for who knows how long. It's becoming rather obvious that this visa process is not one of the fast ones . Sorry I couldn't really offer you a better answer but the previous posts covered your question pretty well.
