Concurrent Filing question

Timeline

I recently filed, and have NOA's for both I-130 and I-485.

485 is appearing on the website and is pending of course.

130 is not.

My question is, do these get processed together for this type of application, or does the I-485 have to wait until I-130 is approved - or is I-130 automatically approved?

03/01/2007 - POE - JFK (L-1 Visa)

01/15/2008 - Proposed

03/15/2008 - Married

09/02/2008 - Sent AOS Package (I-130, I-485, I-693)

09/03/2008 - Received - Signed by SMITH

09/04/2008 - Checks deposited

09/10/2008 - Checks cleared ($1010 + $355)

09/12/2008 - 2 NOA's received (I-130, I-485) - Dated 09/08/08

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

My question is, do these get processed together for this type of application, or does the I-485 have to wait until I-130 is approved - or is I-130 automatically approved?

They get processed concurrently.

Some petitions/applications do not show on the USCIS website, some do - it'####### and miss. Some never show at all. I wouldn't worry about the fact that the I-130 is not showing. The I-485 is more likely to show updates in any case, usually starting with your Biometrics appointment.

I-130 is not approved automatically, it takes time.

I-130 or I-765 or I-485 sometimes cannot be seen online so don't worry. Remember that you'll first be approved the I-130 then at your interview or at the CSC your I-485 will be approved.

Don't let the choices chose you, chose the choices that you want.

I've been told not to worry about not seeing updates online, and that by the time of the interview if the I-130 had not yet been approved then it would be adjudicated and approved (assuming proven legitimacy of relationship to interviewers satisfaction) during the interview.

It doesn't have to be approved separately. It doesn't even have to show up online. Both your files, the I-130 and I-485 are assigned an A# or your Alien file number with USCIS. Status on that A# is pending right now because of your I-485. I-485 cannot get approved until I-130 is approved, Your A# status cannot change to permanent resident until your I-485 is not approved. One thing is dependent upon another. Once I-485 is approved, status on your A# changes from pending to permanent resident and card is issued on your A#, not your I-485.

Don't worry. Everything will come through

Yes- its always good to see others with similar visas! I've been really pleased with the processing speed of our case. However, I do find myself comparing my timeline with and getting a bit envious of all the K-1s getting approved in 60 days or less without interview. But I have to keep in mind but that they'd already had to go through a huge waiting period and the interview process to get their initial fiancee visas. :)

I'll be happy to be under a year, I have no rush right now with L-1 still being valid
