My fiancee is now in America (thanks everyone for your help), and we are getting married next month. After the wedding we will file the AOS. How long after we file the AOS and EAD will she be allowed to work? We heard rumors of 3-4 months!!! That is crazy. Please let me know what you have experienced......

On a different note, I have some foreign friends who come to the states on work or study and end up getting married and living in the states during this process. We decided to go the route of the fiancee visa whist she was in Poland and I was in the states becuase we thought it was the better way. I am not seeing any benefit from doing the fiancee visa anymore! My fiancee had a tourist visa for 10 years. I am thinking it would have been better finacially and emotionally to have had her just come over and get married whilst on the tourst visa. :blink:

What are the benefits of first doing the fiancee visa v.s. coming to the states on another visa and getting married?

60-90 days typical for EAD

On a side note: It is all about intent at time visa is issue or upon entry into the USA. She would run the risk of denial of her AOS for fraud, as they could have denied based on using a non-immigrant visa\entry to circumvent immigration law. How often that actually happens, who knows........
