I have a family reunion in December and since my hubby owns his own business (and as soon as I get my EAD I will be working with him) its going to be a challenge for both of us to leave for more than 2-3 days.

I havent seen some of my Family in 15 years and wanted to stay for 2 weeks, however I was wondering if it is possible or advisable to re- renter the US with the AP but with out my Hubby? (Since he can only stay a few days).

All help and suggests and advise welcome.

You do not need a USC to travel or re-enter.

Even if he was with, not a lot he could do to help anyway.. If the were to decide to deny entry, they will regardless of a USC's presence or not.

AP is NOT for US citizen to enter the USA, it is for NON-Resident Alien to re-enter, so you do-not need US citizen with you when you use AP to enter the USA.

I guess I just got nervous because I had read on here that it was advised to always enter together to avoid complications. However you are right, if they are going to deny entry i mean what is hubby going to do..............Beat the IO. LOL J/K

I've done it about 6 times and was not accompanied by my spouse on any of the entries.

BTW, if you have ever been out of status - do not leave until you have your green card, even if you have the advance parole documents. (I noticed that your entry was 2001. Have you been in status on another visa for all the time prior to your marriage?)

On my first reentry using the AP the I/Os gave me the gears and while I knew they were mixed up in their interpretation of the law, it was still quite disconcerting. I had never been out of status, and had no proof of most entries due to crossing at land crossings and being Canadian.

Subsequent entries were, however, much easier. :star:
