The fight with immigraiton finally over!

Hello VJers,

First we would like to thank all of you who replied and helped us through this difficult journey. I don't even know where to start

Here goes:

My husband applied for AOS on November 28, 2006. 2006, can you believe it. Everything went so fast that we couldn't believe it. Within for weeks, we were scheduled for an interview in Feb 07. The interview went great but the interviewer was not very pleasant. She was persistent that how did we get married without dating. It was an arranged marriage and according to the norms of our culture. Nonetheless, she went away to make some copies and came back to say that she needs to have her supervisor look at this before she can approve the application and we would hear something in 4 weeks. She also told us that the service center didn't send her the I-130 yet. On feb 28, our I-130 was transferred from CSC to Santa Ana. We waited and waited, called, made infopass, didn't do any good. After a while my husband looked at the transfer notice to find out that the address on the NOA for transfer was to Magnolia st and wasn't the one where we were interviewed. He then did an infopass and believe me when I say this, Santa Ana told him that there is an underground office at magnolia street. neither me or my husband bought that and we went to see that address that was listed on the NOA. Found out there was a rehab center. We took some pictures and came back to Santa Ana, they got confused and finally after running around for a while said that the application is with them. We waited and waited. Answers that we got regarding case status was

1. Supervisor / Supervisory Review

2. Extended Review.

3. Security Checks.

and so on.

I wrote the congressman, senators, ombudsman, first lady. Whoever I could think off. Everyone said that the case is pending. I did a service request. They sent me a reply to it saying that there was an RFE sent to you in Feb 07 (Date was the same as our interview) and we didn't reply to it so our case is on hold or in suspension. We got so furious and went to Santa Ana to get a copy of the RFE since it was stated in the service request reply. Local office said that RFE was ordered but was never sent out so she doesn't have anything for me. It turned out to be an ugly argument, us saying that we have a written notice from USCIS that our case is on hold and local office (if they are saying that no RFE was sent out) should issue something in writing. We came back empty handed.

Waited and waited. I talked to a lawyer in March 08 and he said that wait before doing anything since the second anniversary of our marriage was approaching in June. We waited and waited. In July of 08, I did another infopass. Same answers as before. We then started researching for writ of mandamus filing in federal court. After doing much research, finally put together a case and submitted it. Case was against secretary of homeland security, USCIS director, FBI director, CIA director etc. Summons were served on the 4th of Sept. We received a very polite call from Santa Ana to come in and talk. We went to the interview, they took some more evidence namely updated lease and copies of some pictures etc. He said he is ready to approve the case and it will be approved tomorrow, gave us his business card and asked us to call him if there are any problems. He called the next morning and said that my hubby's finger prints expired and sent a fax to go get them done again, he said you can get them done anytime you want before 330 today or anyday other than sunday. We couldn't believe it was USCIS that we were talking to (Politeness). my husband did that on the same day. He got a call from him on Tuesday that our case is approved and faxed us a copy of the front page of 485 showing the approval stamp. That was the 16th of Sept. We then filed to dismiss the case in the federal court. Today we received a welcome letter and status changed online to card production ordered.

Welcome letter says IR6 meaning that he will get a 10 year GC.

All ended well. The reason I am posting my long story is because a lot of people helped me out and I want to pass that on to others who are still stuck in this mess. If you are not doing anything wrong or bad then why should you be scared!

What surprised me is that their tone and way of talking, everything changed. The officer told me not to worry as his whole office is scrambling to get this case off their hands.. Its just amazing..

Congratulations! One person probably made a "minor" screw up one time and caused all of this hassle for you and all of their co-workers at the USCIS, not to mention expense.
