I am from Burma. After living for years in USA, I just become US citizen. I have a girl friend that recently has a chance to escape from Burma to Thailand with her Burmese passport.

I was never been able to go visit Burma to meet her before and although after receiving the US citizenship. I believe everyone in the world knows about Burma regime and their heartless abuses to Burmese people. After the so many ways of trying, she reached Thailand where has a lot more humanities than Burma.

I am now urgently looking for a way to bring her to USA. My plan was to go Thailand, marry her there, go see US Embassy as necessary, and bring her here.

Can you advise me the steps and requirements to do so, please?

Go to the guides and read the step for a K3 visa.

You can't file fot DCF unless you've lived in Thailand for more than 6 months. If you still want to marry before filing, then a K3 or CR1 visa are your only options. Also, you can postpone the marriage, file for a K1 visa (fiancée) and marry once she arrives in the US. All the steps needed are in the Guides.

What is her status in Thailand? Has she applied for asylum? I believe you need to have legal status in the consular district you will be applying in. Your case might be complex enough to consult with a good immigration lawyer. Best of luck.

I fyou get married in Thailand and file a K3.. you're interview will be in Thailand... regardless of what her status is... thats the law in the life act... the interview must take place in the country of marriage.

Great! This is a helpful forum with informative people. I really appreciate all of you.

She has 3 months visa at this moment.

I have visited Guides section and read K1 and K3 visa. Is K1 better and shorter process for our situation?

I searched on internet and found a few Fiancee Visa Law Firm sites, but don't know if I should go with any of them or do it on my own. I really want it to be happened as soon as possible.

Please advise me.

K1 is quicker, because you can start now (provided you have met in person in the last 2 years), and don't have to wait till you can meet again and marry to start the process. But if she/you want family at the wedding, K3 may be better because it could be difficult for them to get US tourist visas to see you. Neither visa will be done in the 3 months she has on her current visa....

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

They haven't met in person yet, so any spouse or fiance via process will have to wait until they do.

To the OP, there's nothing fast about this process. You could look into the possibility of asylum but otherwise you'll be supporting her in Thailand for several months to a year. Of course she'll need a legal way to remain in Thailand that long.

You may also have an uphill battle showing bona fides of the relationship. The best way to do that is with multiple in person visits. We all wish it were as simple as you may have imagined but it isn't.

I think you will have an easier time in multiple ways, if you marry in Thailand but you'll also need to check into how two foreigners go about doing that. Marrying in Thailand assures the interview is in Thailand. Otherwise the visa would need to be issued in her country of legal residence.
