answered YES to the drug question on I-129F. What do I do now?

Hi,

I am filing an I-129F and am the petitioner. I have 3 posession arrests over 20 years. No violence on my record. No drug sales. So I have to check YES to the question. My question is how much detail do I have to send along with the I-129F. I was going to send my judgements of conviction. I am 50 years now and totally straight. The other question is will this quash my attempt to bring my fiancee here? She knows all about everything. No secrets. It is obvious I don't know much about this subject. Someone please give me a few pointers.

I would send in your petition with a copy of the police reports. I don't know that you will be denied, but you are required to answer yes to the question, you do have to send in your court reports about the convictions, at least it's my understanding given there was 3 seperate convictions.

I don't think it would hurt to prepare a covering letter explaining how old the convicitions were and how things have changed.

No you will not get denied based upon your criminal history unless it involves the adam walsh act. And yes you need to attach a copy of your police record from the state police in which the offense took place in. The reason for the questions on the I-129f is to make sure that your fiance is well informed of your past.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

based on what i have read here when this topic comes up in the past is if u the usa person has the problem u can still file for visa for ur spouse or fiance..........could take u awhile to get it done .........but if it was the non usa person no chance of getting visa

Thanks for that information. I noted you had a question relating to this. I have looked into this considerably since we made posts. The answer to your question is dui. Dui, you should answer dui. You have now seen about 1/40th of my Mandrin vocabulary. I am thinking about getting one of those Rosetta Stone discs but I can't find anyone that will recommend one. Have you heard anything?

07/15/08[/font] Sent off I 129F

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

My attorney falsely told me not to send in court records until they were asked for. Now it has been 2 weeks since I sent back the RFE, so be sure to send the court records with your application. The USCIS site says I have up to a 60 day wait now. At least the lawyer is through Mexican / American Ministries and only cost a 80 dollar donation. But when I first filed the Attorney sent papers to Nebraska which cost me 3 1/2 months time since they did not send it to California. Now is another 2 weeks so far since she did not add court papers to original filing. I should have trusted myself to file it, but i wanted someone to make everything was in order.. So my advice is send court papers in with application GOOD LUCK TO U

Yes, I have understood that as well. You weren't the original poster, however I answered the OP by saying to send in the police reports with the waiver. That was my understanding.

Glad that you didn't lose much money, but unfortunately you did lose all that time! All the best that things move much more quickly now.
