confuse with our lawyer

hi..

my fiance wil be here next month and will be staying for months..we were hoping that when is here we might get our NOA2 already..so in preparation..i emailed our lawyer..

i asked him if he can just notarized the affidavit of support and mail it to us (Philippines) when we will need it already for the interview.

he replied that he cant notarized it as it needs to have my fiance be there for the signing of the affidavit of support.

is this true? can he just notarized it and send it to us so that we can fill out the form?

The I-134 form is the Affidavit of Support for the K1 Visa. Your fiance has to sign the form in front of a notary and have the notary witness his signature and attach their seal to the form. Your lawyer will prepare the form and send it to your husband so he can do the notary part. Your Fiance can bring the form to you once it is notarized.

Why not have your fiance prepare it in advance before he leaves and bring it along with him since his traveling back here.

Aug.22,2008- Interview PASSED (Pink Slip Only)

Aug.29,2008- VISA ON HAND

Sept.3,2008- POE Houston TX

October 25, 2008 - Officially Mrs. Eaton

AOS Timeline:

March 10, 2009 - AOS package sent to USCIS via FedEx

March 12, 2009 12:21pm - AOS package delivered to USCIS

March 20, 2009 - Check cashed

March 21, 2009 - NOA1 for I-485, I-131 and I-765

March 24, 2009 - Received Biometrics Appointment

April 4, 2009 - Case transferred to CSC

April 7, 2009 - Biometrics appointment is done

May 4, 2009 - AP approval notice received

May 8,2008 - EAD received

June 3, 2009 - Welcome notice from CRIS via email

June 8, 2009 - Receive hard copy of welcome notice on the mail

June 15, 2009 - Card production ordered

June 27, 2009 - Green Card on hand ( 2 years )

Here in Philippines, it is possible to just give the paper to the lawyer and have them notarized. In US, you really have to be physically present to sign the papers. And yeah, why don't you ask your fiancee to just bring the notarized affidavit of support when he comes here?

August 27, 2008 - Interview

September 08,2008 - Document Verification request sent to NSO

Spetember 19,2008 - Document Verification done -sent back to US Embassy Manila

November 03, 2008 - Case under review

November 26, 2008 - VISA printed

November 28, 2008 - VISA in transit

December 02, 2008- VISA IN HAND

January 12, 2009 - Arrived USA, POE Los Angeles

January 21, 2009 - Got married

January 22, 2009 - Applied for SSN

March 17, 2009 - Biometrics Appointment

March 21, 2009 - SSN card arrived in the mail

April 6, 2009 - took driver's license exam and passed! (written and road test)

April 10, 2009 - Repeat Biometrics Appointment

April 14,2009 - Received AP documents in the mail

April 16, 2009 - Received EAD in the mail

SEptember 4, 2009 - GREENCARD received

No, your lawyer cannot notarize it as the signer has to be standing in person in front of the notary. While in the Philippines you can go to any U.S. Consulate nad have it notarized, but they will also tell you that the USEM no longer requires that the I-134 be "Sworn"!

one more question..for example he will bring the affidavit of support nect month (october) and the interview is on january (nexy year) will still it be valid?
