My stepdaughters (2) K-2 visa was just rejected ky the Bangkok embassy.

Per the instructions we had to apply for the K-2 within one year from the issue of the K-1 visa (11 September).

We applied well within that timeframe (several month ago), and they were interviewed on 25 August. At that time the CO asked for some additional papers which were delivered to the embassy on 2 September. At this time the CO took their passports and said everything was ok, and they would be called when everything is ready.

Today, 22 Sept., the embassy called, and said to pick up their passports.

You can imagine their shock, when some A-hole handed them their passports, and all their paperwork, and said "Sorry, it is past 11 September, we cannot give you a visa".

The embassy had all the required papers by 2 September.

What do I do now? I don't want to start the whole process over again? Is there a way to contact the ambassador in the embassy? What about a senator?

These jerks are pathetic.

AOS Timeline

11/29/07 - Fedex'd to Lockbox (Chicago)

12/3/07 - Delivery confirmation..........

12/21/07 - Checks cashed!!!

01/10/08 Paper NOA1 for daughter received - Postmarked 12/20/07

MSC# on back of check doesn't match MSC# on NOA.

01/31/08 Still no news for wife. All three numbers still come up red on-line.

02/26/08 Called USCIS 800 number. Very friendly and helpful individual and supervisor.

Found out correct MSC numbers. Also found out that we missed the Bio!

We never received any appointment letter. (Originally set for January)

Went to local support office and asked about re-scheduling the Bio. Very nice manager at the office

did our Bio then and there, without having to wait since they were not busy.

April 8 and still waiting.......

May 11....and waiting, and waiting...not even a touch.

May 24 received NOA2 appointment for Interview for 30 July. Web page still not updated.

July 30 - Interview. APPROVED. Green card will be sent.

9/12/08 Called USCIS asking where GC's are?

10/15/08 Get letter from USCIS that GC's were sent August 8. Never received them.

10/20/08 Sent forms and $740 for two new GC's.

11/7/08 Received confirmation of receipt for new GC's.

11/12/08 Received BIO appointment.

11/25/08 Bio done.

Waiting, waiting, waiting

January 2009 finally received GC!

May 3 2010 Filed for Removal of Conditions.

June 21 Bio appointment.

August 11 Approval letter. No Interview.

August 21 - 10 Year card received.

March 16, 2008 - NOA2

August 7&9,2008 - Medical K1&K2

August 21, 2008 - Paid document verification fee (P1,300)

August 27, 2008 - Interview

September 08,2008 - Document Verification request sent to NSO

Spetember 19,2008 - Document Verification done -sent back to US Embassy Manila

November 03, 2008 - Case under review

November 26, 2008 - VISA printed

November 28, 2008 - VISA in transit

December 02, 2008- VISA IN HAND

January 12, 2009 - Arrived USA, POE Los Angeles

January 21, 2009 - Got married

January 22, 2009 - Applied for SSN

March 21, 2009 - SSN card arrived in the mail

April 6, 2009 - took driver's license exam and passed! (written and road test)

April 10, 2009 - Repeat Biometrics Appointment

April 14,2009 - Received AP documents in the mail

April 16, 2009 - Received EAD in the mail

SEptember 4, 2009 - GREENCARD received

The K-2 needed to have been issued within 1 year of the K-1 (not just applied for). Regardless, if your timeline is correct, it appears they should have been able to comply...

You need to rattle some cages for sure.... Senator, Consulate General of BKK, visasbkk@state.gov

Did you ever submit an I-130 for the child?

so sorry to hear this. Seems nobody does their job anymore. :(

Document everything (including anything that shows you got the evidence requested to them on time) and get in touch with the Embassy/Consulate as well as your own representatives.

You'll probably want to check with others in the Sawasdee thread here as well. There are many there familiar with the USEM. ;)

I'd call your senator or representative's office and talk to their immigration specialist. Tell them that it is urgent, as perhaps this decision can still be reviewed and overturned at the consulate. If it is their mistake and/or untimely handling of the paperwork and the immigration benefits are otherwise qualified for, it should be overturned.

Email the same info to the embassy. If you get the auto-reply you might want to immediately try the visas2bkk@state.gov, which some have had more luck in getting a response to.

Another source that was helpful to us is listed below. You can talk to a person, you just have expect to be on hold first. One guy we talked to there knew what he was talking about and told us exactly what we needed to do (he was right, too). I'm sure, as is the case everyplace else, that some people are more helpful than others:

U.S. State Department Visa Office: Information is available to the public by telephone at the Visa Services, Public Inquiries Division at telephone (202) 663-1225 or by FAX at 202 663-3899. The telephone number provides the caller with a selection of pre-recorded information and the ability to talk to a visa specialist during business hours.

can someone explain me the process for the K-2 visa? just reading this i feel so sorry, thats horrible to have the daughter and stepdaughter of a person denied. In my case this cannot happen because my future step-daughter is only 10 years old and we are depending on the K-2 visa for her. I thought the process was to put any child of the beneficiary on the I-129F form. but after reading this i must do that, then wait until i marry, then file a I-130 for the daughter? is this correct? sorry for not opening another thread and intruding here but i figured it was on the same topic....thank you and excuse me...

There is a different procedure if the K-2 will travel at the same time as the K-1 or will the benneficiary exercise the "follow-to-join" benefit. In the OP's case the wanted the "follow-to-join" (up to one year after the K-1) and it appears they cut it too close.....
