As long as she stays here and they get married she can file the I-485/I-130.

If she decides to leave the country now I believe she incurs a ban since she has overstayed by 180 days (someone correct me if I am wrong).

They need to stop shuffling their feet and DO SOMETHING!!!!!!

(IMO) I could not agree more! :thumbs: I'm on pins and needles for them and don't even know them.. All this time they are waiting... they need to show them that they do want to be together! It seems once they found out she may need to go back, that they were throwin in the towel so to speak (IMO). Hope they put a move on! Hope it works out!!

I think they have thrown in the towel...all the control is through her fiance and he is not reachable if you know what I mean...( She can't talk about the immigration situation when he is around.) Even if I told her to get married now it seems it take two to get married and I can't talk to her fiance... she is the only one I can speak to. Eveytime I mention letting me speak to her fiance...she gets tense and says he really is done with this immigration stuff and has asked HIS immigration officer and others many times before I just came along and they have accepted her faith of her going back to Ghana a while ago until she met me that day in the supermarket and I had brought hope that she didnt have to go all for her hopes to come crashing down again!

I feel so bad for her... she is sooo nice... when she met me and my husband at the supermarket and we were talking... she gave my husband and I some cheese, milk, cereal and apple juice that she gets for free from the government since she has a new born and is WIC a program for mothers and babies and she said she gets soo much so she gave some to me and my husband. That day her husband was waiting outside in the parking lot in the car and so we met him but he was not that talkative.

I have givenup... I feel bad getting her hopes up and then bringing it down. I didn't know at the time that they were not yet married .... and now she says her fiance doesnt want to hear anymore about immigration stuff he is tired of it.

09/2007 - Gathered all documents for I-129F petition.

11/09/2007 - Sent I-129F

11/21/2007 - Package sent back to me( I forgot to sign one of my G-325A forms) I cried my eyes out but sent it next day delivery back to USCIS.

11/27/2007 - Received NOA1

02/13/2008 - Received NOA2

02/20/2008 - Package left NVC

02/22/2008 - Case uploaded into Ghana consulate data system

04/08/2008 - Packet 3 & 4 sent to fiance

04/16/2008 - Packet 3 & 4 received by fiance

06/24/2008 - Interview date (God blessings on this day)

06/24/2008 - DENIED visa at interview

06/25/2008 - APPROVED visa at 2nd interview with senior consulate

06/27/2008 - Picked up VISA

07/03/2008 - Fiance entered USA at JFK POE & Got EAD Stamp in passport

07/18/2008 - Married

08/07/2008 - Mailed AOS application

I think the best thing you can do for her is to tell her that she is better off returning to Ghana. Does she want to stay here illegally? What kind of life can she give to her child?

As for the man, does she want to stay with a guy who does not even love you enough to marry her? Forget about immigration and the paperwork that they were supposed to have filed, he brought her here to marry her and has basically backed out. She is not doing herself any favors by staying here, that is for sure. And as much as she may want to make the relationship work, the fact that he has basically said "there is nothing more I can do" and is sitting back on his hands, leaving her to her own devices, with a BABY, says a lot about his character.

Its a sad situation.

WOW! I felt it was (throwin in the towel) from the way it sounds that he is acting. I have read post where the interview has been denied and the person has gone back begging and pleading doing all they can and not taking no for an answer. Or juss doing all they can. My heart feels very heavy for her!!! Her hopes it seems were up with a man bringing her over here and knew he had the 90dys and (IMO) now wanting her to go back! How sad!!! I am glad that she has you as a friend. B/c it seems you and your husband are the only ones reaching out to her.

(IMO) It even seems if someone told him that he could marry her I really don't think that he would. From the way he acts he is done with it all! Thanks for keeping us updated!

I am not an immigration lawyer, but I have read quite a lot on things like this here and elsewhere. She entered the US legally and should not leave if she expects to fix this. The bottom line is that your friend is now the mother of a US Citizen, and she is in the best position to fix her situation here in the USA, rather than return to Ghana and try to come back. There is also a matter of child support that she should pursue while she is here.

The problem with that is unless she gets married to the petitioner, there is NO WAY she can become a permanent resident and, if she stays past the date on her I-94 (which I am sure she has) then she is essentially here illegally. The purpose of the K-1 is for the foreign beneficiary to enter the US, get married to the petitioner within 90 days and then adjust status. If the marraige does not take place then she is just like any other visitor to the US and has to leave by the date on her I-94.

Being the mother of a USC does not give her special rights under the law. The only one that has rights are the USC child. She cannot stay here and fix her situation by beneit of being the mother of a USC.

I agree with just about everything you say, except the part that says "THERE IS NO WAY." There is always a way with a good immigratrion lawyer. True, being the mother of a USC does not give her special rights under the law. My point was that, even though she is currently an illegal alien, she came here legally and her circumstances, her entire life, has changed because of a deadbeat US dad. I am sure there is case law in the that can be argued for her to stay. She needs to see a lawyer before she goes back.
