It's just as "pushbrk" stated earlier. Did your fiance enter LEGALLY (ie:visitor, student, worker visa ) and overstayed OR did he/she enter the USA illegally ?

If it's just a matter of overstaying a visa, then the fiance CAN adjust status while REMAINING in the United States. Ensure that he/she has the I-94 handy, which you will need later on.

If it's the case where he/she entered ILLEGALLY ( jump the fence - sort to speak) then consult with an immigration attorney immediately. IT CAN BE DONE ALSO WITHOUT HIM/HER LEAVING THE USA. However, It will be an extremely LENGHTY process.

The OP started another thread on this topic. The entry was illegal. He cannot adjust status without leaving the country.

I'm not trying to start trouble but the matter of fact reactions from everyone else were rather disappointing. I've had a hell of a time getting my fiancee here legally with all the hoops we have to jump through & I'm sorry but I have little sympathy for those who are in the USA illegally.

I understand exactly where you're coming from. But in the case which the OP has posted, the entry was illegal, so he cannot adjust status in the US. He must return to Mexico for the waiver process. So he really doesn't get a free pass. The law allows for a waiver of inadmissability even for an illegal entry if certain requirements are must, much like a legal entry and subsequent overstay. It sucks but it's the law.

I can't really say this kind of situation offends me, but it sure does make me feel stupid. Having tried so many things legally and then failing to get them done, too, I really do feel that the safest way to accomplish something is to just do it - illegaly.

I am sorry that you feel this way, what have you tried that has failed, you only got your NOA 1 at the end of August no offence meant

yup I do, have no sympathy whatsoever.

Its the same as someone breaking into your house and eating your food.

This is the second time I am going through this visa process and nothing f*&^&^ing pisses me off more than these coming across the border illegally.

im sorry about ur situation..........but i have to say that even with all the wait we have been doing well over 300 days now we still would not do it illegally..........people that come her illegally or pay to have someone marry them is part of the reason people like us are in this long long wait in the process ...........im not judging dont get me wrong i know most come here for work because they are suffering so much in their own country......but do it legally plz.

That is exactly what they have to do in order for a chance to become legal. It cannot be done without leaving the US. Of course who knows what the next administration will do concerining immigration reform, probably make it easy for the 15 million illegals to stay. I for one will have very strong feelings against giving everyone a free pass after what my wife and I have been thru to immigrate legally. What the government should do is fix the system for those of us doing it legally, make it more efficient instead of rewarding those who ignore the law.

There are a bunch of posts on this forum that explain what all we have done so far, how or why. Nothing has worked, except for getting this NOA1. Even the last CO I talked to last month said that the more honest you are, the worse you have it.

So go figure.
