Just like many of us, I am waiting for the holy grail of USCIS or NOA2. In my case I have a way that I can see my wife every weekend if she gets canadian visitor visa. She has a brother who is currently working in Vancouver BC and I live in Portland OR. So if she gets there I can drive 5 hrs every weekend to see her.

I take K3 out of picture since it can be issued in the country where marriage took place which is India. So the question is once she gets the NOA2 for I130 approved,

1) can we able to do CR1 process at US consulate in Canada where she would be visiting? If this is not possible we always have the backup plan to have her go back to India where our K3 and CR1 visa will be processing.

2)Also would we need the Police report of living in Canada for our K3 and CR1 visa?

3) if this all be possible that she comes to Canada, would she be able to cross border legally for a weekend visit to me?

4) If she does cross border somehow (legally of course), will this become a problem for her immigration to USA on K3 or CR1?

I will appreciate responses. Thanks

1/ No problem with I-130 petition when your wife comes to visit Canada and you will drive there to meet her

Applying CR1 in US counsulate in Canada : I'm not sure however it's not recommended. The process is already complicated. You should do it via Indian counsulate. While waiting for CR1 visa, your wife can travel anywhere she wants

2/ If she stays in Canada for more than 6 months, she will need to obtain Canada police record + Indian Police record when being requested by Indian counsulate or NVC later stage of I-130 petitition.

3 & 4/ If she can get a tourist visa (B2 visa) while staying in Canada, she can cross border to US. However, the change to get B2 visa is 10% or less. Good luck
