Hi everybody,

I am hoping someone out there is willing to help me see beyond the frustration I am facing right now.

My wife and I got married in the Netherlands Antilles in January of this year, and much deliberation decided that we should file a K3 application on my behalf. After we filed the application, we received the NOA on March 6 2008 and after posting the 2nd batch of applications we received an approval notification for the I-129f and I-130. Unaware of how to pursue the next line of action we adopted a wait and see attitude and the last thing we did was to pay for an affidavit of support last night.

My questions are as follows

1. Should we keep working with this approach or is it counter-productive

2. If there is a better approach what could it be

3. I have been informed that the consulate that will be handling my case is situated in Barbados, does anyone have any info on that consulate

4. Should we wait for the next set of applications to fill out or should we go ahead and source them out and fill them and send them?

5. Should we wait for the Consulate to tell us when the interview date is or do we have to schedule this ourselves?

6. How long after the Consulate receives the application from me can I expect to wait before I am called for the interview or should I go ahead and schedule that now.

Well, first you must understand the first petition you filed, (I-130) if filed alone would result in the preferred visa, a CR1. The second petition (I-129F) is the one that would result in a K3 visa.

The affidavit of support fee you just paid would be in connection with the I-130 and CR1 visa path. There's lots of discussion here on whether it's better to pursue the CR1 or the K3. You can read it to your heart's content but in short, the K3 is faster and ultimately significantly more expensive, since you arrive without authorization to work and still have another $1010 in fees to pay to adjust status to permanent resident and get a work permit, maybe three or four months after filing. This filing is after entry.

The CR1 visa may take a month or two longer but is less expensive and you enter as a permanent resident with work authorization. Within two to six weeks, you would have a Social Security number and could take a job. You'd also skip the $1010 fee and associated adjustment process.

Since you've already paid the affidavit of support fee, I'd seriously consider continuing down that path.

Your I-129F will continue to the Consulate on its own and have an interview scheduled for a K3 visa. If your I-130 catches up, that interview would end up being for a CR1 visa. There's a link here for ways to speed your way through the CR1 process you're in now. I'm sure somebody will be along soon to provide it or you can just look for it in the IR1/CR1 forum.

pursue with the i-130 coz thats what we did...im now here in the US after 9 months.good luck

yes definitely pursue the I-130. there are plenty of threads on this forum discussing how to handle this situation.

Also, can you fill in your timeline and let us know when you received the approval?

Congratulations to your wife and you! Since you received your NOA2, I think you should continue with the I129 b/c your wife will be able to come here. Call the Nat'l Visa Center & ask about an interview date and the medical. They should be able to give you more info & guidance. **We are still waiting for our NOA2 (since March 25th!), so feel blessed that you received your already. That's more hopeful, I think. I will definitely fill in my time line, as you can see i am new to all this and i must say I feel a measure of sanity returning :whistle:

After totally scouring the forums I have gathered it is best to pursue the I-130 as it is the one that best helps with life after the visa approval , ie work permit, ssn etc.

Now my question is will pursuing both I-129f and the CR-1 applications sort of slow each other down or is best to temporarily abandon the I-129f?

I need to know as i do not wish to spend anytime longer than I already have away from my wife. :crying:

In most cases, the I130 is the best - continue that route as there are so many more benefits, and with the ability to pay fees on line now, there is not a big difference anymore in wait time at NVC- use to be months, now maybe a few weeks!!!!!!

Thanks to all the the members for your useful, helpful inputs. I was just wondering what happens if the I-130 or 129f (which ever comes first) interview yields negative result ( Nobody hopes for that anyway). Can he still pursue the other. Just curious and a way of having eggs in different baskets.
