Hi, I have a quick question regarding the application for employment authoriztion form (I-765), my Visa runs out today, and we have not yet sent off my AOS application, so for Q. 15 Current Immigration Status, do I just keep K-1 as in the guide, or do I put out of status, or what?

Thanks, Michael

Michael,

Do you mean that your I-94 expires today? (When your visa expires is not relevant.)

You are planning to send this I-765 with or after the I-485, correct?

I think you are a K1 visa holder no matter the expiration date of your I-94.

Michael are you filling out the forms?? If so then on one of them you put C9..I had a bit of a time trying to figure out what status I was in (or should that be what state I was in hehehe) anyway hope this answers your question. As for your I-94 running out I have read that people have applied for the AOS after this has expiried, so do not panic ....Good luck.
