Timeline

My situation is:

I got my SSN when I arrived, before I got married.

I also got the State ID's card, before marriage.

I went yesterday to the SS office and they said they can't change my name because they need the EAD. I read about it and, unfortunately, my marriage certificate doesn't have my DOB or my age or my parent's names, so I really cannot change it now.

Also yesterday, we went to the DL office to change my name on the ID card and it was sucessful!

Now, Im worried if I will need to wait for EAD to arrive, to be able to apply for DL. Or, if I will be able to get it because I already have my ID card info in that office.

What do you think???

When does Your ID card expire now? Here in Ca they would only issue my wife an ID card for the length of her I-94. They would not re issue one after we were married because her K-1 expired and she had no legal proof of her status in the US until she got her EAD. Once she showed the EAD she was able to get an ID card in her married name for the term of the EAD. (1 year) But she did sucessfuully take her drivers liscense test and they issued it for 4 years. Makes no sense to me.

If you are only interested in correcting the name on your SSN record, but not being issued a card it seems to me that you can correct the SSN record with your State ID in your married name and your marriage certificate and another acceptable identity document with the name that's currently on your SSN record.

RM 00203.200 Evidence of Identity for an SSN Card

If an applicant states after being questioned that he or she has a document available that is higher in probative value than the document that he or she submitted with the application, we must tell the applicant to provide the document of higher probative value.

“Available” means the document exists and the applicant can access or obtain it within 10 business days. However, “available” does not mean that an applicant must obtain a document that has never been issued to him or her, just because it could possibly be obtain in 10 days, i.e. apply for a passport, state driver’s license or identification card.

If Primary evidence is not available, secondary evidence can be submitted.

ALIEN: Adult Age 18 and older

Secondary Evidence

-- U.S. driver’s license (not expired)

-- U.S. State issued non-driver identity card (issued by the same State agency which issues driver’s licenses and not expired)

-- Medical record (clinic, doctor, or hospital)

NOTE: A receipt or a record of treatment recorded and maintained by the applicant or the applicant's family is not acceptable.

-- Health insurance or Medicaid card showing, in addition to the person’s name, either a photograph of the person or his/her DOB

-- School identity card (for current school year) showing, in addition to the applicant’s name, either a photograph of the applicant or the applicant’s DOB

-- Life insurance policy for the person showing his/her age or DOB.

The applicant may submit either:

One legal name change document showing both the old and new names (e.g., a court order for a name change or a marriage document. The document must also show either (1) a description or photograph of the person or (2) biographical information that can be compared with the Numident data. Additional evidence should be requested if there is a question about the validity of the evidence or the identity of the applicant; or

When the name change document does not show either a photograph of the person or biographical information that can be compared with the Numident data, then, in addition to the name change document, the applicant must also submit two identity documents listed in RM 00203.200E. One of the submitted identity documents must show the old name (the name on the latest Numident record) AND the other submitted identity document must show the new name (the name to be shown on the corrected SSN card). The identity documents submitted must show either a photograph of the applicant or provide biographical information that can be compared with the Numident data.

Both of the ID cards (the first one and the one with my name change), expires on my birthday on 2010.

Thanks for the info... Actually, Im more worried with the DL. The lady at SSA asked me at first: Are you authorized to work? I said no and she said that she couldn't even try to change my address because the computer system doesnt let her do it unless I have the EAD. :wacko::huh:

Im really wondering if I can apply for DL now without the EAD... Im guessing yes, because the DL office already have my profile in there and I have an ID card with 4 years validity. Am I right??? :unsure:

Your address? What does your address have to do with this? That woman is full of it there is procedure to assign an SSN for an illegal alien, so they sure as hell can update your SSN record if you provide your marriage certificate and acceptable indentity documents with your current and previous name. You have the marriage certificate and state ID with your married name. You just need a document in the name that on your SSN record.

A nonwork SSN may be assigned to an illegal or undocumented alien if an SSN is required as a condition to receive a federally-funded benefit and the individual has already provided documentation that he/she is entitled to the federally funded benefit. Such federally-funded benefits are:

-- A title II benefit;

-- Title XVI (SSI) payments;

-- Title XVIII benefits when the beneficiary is determined to have end stage renal disease;

-- AFDC;

-- Medicaid; or

-- Food Stamps.

My case is similar to yours, I had my SSN from living previously in the US, also, I was able to get my State ID, showing that SS card, and my marriage certificate and all the AOS NOAs in order to prove that I was legally in the country.

Later on, (actually a couple of weeks ago), I went to the DMV to apply for my Driver's License. Again, I came carrying all the AOS paperwork, marriage certificate passport and all the whathaveyous...

I was totally in shock when this guy told me, you already proved your are legally in the country, all I need is your SS card and your ID, and you can take the test (good shock).

My SS card is still in my maiden name, and I havent changed it because I was waiting for my EAD to come thru, and then I havent had much time to go and change it.

But I guess what MDYoung is trying to tell you, is that now you can go to the SS office with your State ID, and your Passport and your marriage certificate, and change your name on the card.

But I guess what MDYoung is trying to tell you, is that now you can go to the SS office with your State ID, and your Passport and your marriage certificate, and change your name on the card.

If you provide your marriage certificate and acceptable indentity documents with your current and previous name. You have the marriage certificate and state ID with your married name. You just need a document in the name that on your SSN record. Passport is not an acceptable identity document for an adult alien.
