My wife is at the point of completing the DS230...and I understand that the biological father's info is needed on the form. But the biological father IS NOT on the birth certificate, my wife has an affidavit of illegitimacy for her daughter, and the biological father has never provided financial nor emotional support during the entire 5+ years of her precious life.

Nor was my wife ever married to him.

Will we be REQUIRED to have a letter of consent from the father, in order for the baby to be able to leave the country? The father cannot be found; what is needed for that? Will NVC process our packet and send it on to teh embassy or will then deny the application or put it on hold?

Can my wife just put "n/a" for all of his info since he has NO legal rights to her? According to Filipino law...she legally has no father.

Alot of questions with no guidance at this point...please any info anyone can provide would be VERY helpful.

i did call NVC 5 different times and got 5 different answers

09-06-08 - Emailed DS-3032 --- auto response (email that NVC recieved an email from Grace, nothing more)

09-09-08 - AOS bill --- PAID!! (noted on travel web site as "PAID")

09-11-09 - Grace recieved DS-3032s, still no response to the email...(wife got a birthday package from her hubby :) )

09-12-09 - Mailed DS-3032 via FedEx. Also mailed out AOS(paper mailed just to be certain they get one)

09-15-09 - NVC accepts DS-3032..FINALLY!!!(verified via email response and telephone call)

09-15-09 - IV Bill paid online - in process($400 X 2)

09-16-08 - AOS revieced by NVC and being reviewed.(verified via telephone call)

09-17-08 - Immigrant VISA Bill fee "PAID" (verified on-line)

09-24-08 - AOS approved(verified via telephone call)

10-06-08 - DS230 recieved by NVC

10-10-08 - CASE COMPLETED AT NVC

10-29-08 - Appointment Schedule for 12-9-2008(verified by telephone call to NVC)

11-03-08 - Recieved Appointment letter via snail mail

11-25-08 - Medical Exam at St. Lukes Medical Center

12-09-08 - Interview at 630am.......VISAs APPROVED!!

You can put the info of the biological father. It will not affect them leaving the country as long as the child is travelling with the mother, they do not need a letter of consent from the biological father or permission from DSWD. Me and my 11-year old daughter is now here in the US. At the airport, I just showed the birth certificate of my daughter to prove that I am the mother. Next time post your questions in the Philippine Thread as most people are quick to give answers there and help out because of similar experiences.

It will not cause any red flag. Do not worry too much. If your wife has no unterminated prior marriage then you are good to go.

This issue has caused us both a great deal of stress over the last coupleof days. There will still be a lot of apprehension over this issue.

would submitting the affidavit of illegitiacyalong with teh DS230 be a wise decision?

It will not hurt. In my opinion it is not a major document. The NVC & US Embassy in Manila will only require NSO Marriage Certificate, Birth Certificates of your wife and stepchild, Certificate of No Marriages or CENOMAR(it will list your marriage because she is already married), NBI Clearance of your wife, I-864 for your wife and stepchild and proofs of your on-going marital relationship like phone bills, joint bank accounts, insurance policy that she is your beneficiary, pictures together, receipts of money transfer, emails & snail mails. Your main objective is to prove to NVC and US Embassy that you have a legitimate relationship. If you have all that covered then your stepchild will be fine with or without that affidavit because the stepchild is a dependent of your wife's visa if it gets approved. So you need to focus on those documents that I listed above. The document that will be needed for your stepchild is just the birth certificate proving that she is really the child of your wife.
