After 7 months of not hearing anything we got a notice of action for an interview

So my wife came over on a K1 visa. She had her medical examination and vaccination done in Korea in Oct 14 right before we came to the US.

I am getting conflicting reports about the I-693. Does she need it or not? Do I need to shell out another several hundred dollars for something that was already done? Can I call the medican exam office in Korea and request the file? Is it even the same form used to get the K1 visa? On the notice it keeps on saying (unless already submitted)

The port of entry took her immigration packet which included her Birth Certificate and Medical/vaccination exams.

Also, I read on the forum that if she came over on the K1 visa, then the medical examination could be waived...however it is only good for one yr from the date the AOS was filed. The medical exam was done on 10/14/07....AOS was re-filed 01/28/08.....our interview in on 10/22/08. So if it can be waived does that mean it will expire?

9/6/2007 Seoul embassy finally receives application/filed for interview

10/29/2007 Filed for marriage certificate

11/24/2007 Filed for AOS I-485 and AP

12/18/2007 Received RFE (overpaid, had to resend check)

1/24/2008 USCIS resumed application process/biometrics appt received

2/04/2008 Biometrics appt

4/??/2008 AP approved and received

9/??/2008 AOS interview schedule received

10/22/2008 AOS interview

11/3/2008 RFE received and returned

FAST FORWARD to Dec 2012. US CITIZEN!!

You should read the instructions to the I-693 and I-485. They will tell you EXACTLY what you are supposed to do. Later I will tell you what some people have done.

From I-693 instructions, page 4, section III:

2. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e), or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen, and

C. You received a medical examination prior to admission, then-

a.) You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination.

b.) You will, however, be required to complete Part 1, Information about you, and submit the vaccination section of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5, the Civil Surgeon's Certification.

So, you don't need a new physical but must show that you have satisfied the vaccination requirements. You are supposed to take your vaccination worksheet copy (DS-3025, aka DS-2053) that should have been given to you at your exam in Korea to a Civil Surgeon in your area and they should transcribe the worksheet onto the form I-693. If you don't have the vaccination records, then you have a problem and may have to repeat some or all vaccinations. Many CS's are such money-hungry crooks that they will lie and try to convince you that you need to do a full exam again or you will have a problem. NOT TRUE.

Try to find one that will just transcribe the vaccinations and sign it for a reduced fee (<$50 is reasonable). Bring the instructions of the I-693 that CLEARLY say that you do not need another exam, bloodwork, nor X-ray with you to the CS's office if they try to say that you are wrong. Sometimes, they really are that clueless and when they read the instructions, will change their tune.

Now that you know what is required, let me tell you what some people have done. There is a Civil Surgeon in Texas named Dr. Arnold. She will transcribe the vaccination info onto the 693 by mail. You send her your documnents and sign part I and she'll do the rest and return it to you in less than a week filled out and sealed to submit with your AOS. She charges $20 for this service. Do a search for her and you'll get her office phone number to call for more info.

The other thing some people have done and been successful is to just send a copy of the DS-3025/2053 instead of the I-693. Some people have had trouble finding a CS who would just transcribe the info onto the form, so they did it this way. Some have been approved this way while a couple have gotten RFE's. So it's not 100% sure. But if it works it can save a lot of money if the CS's in your area are all crooks.

It's your choice, but now you know your options.
