Unmarried Daughter have a child

My dad is US citizen. He opened file I-130 for my sister (over 21) in 2005. My sister divorced in 2003. She has a child. When my dad open I-130 file. The lawer said that my father only filled out I-130 for my sister and claiming her son in this I-130. Now my dad received the I-797C approve for this case. But only there is my sister's name on this paper. Can I ask my dad did the right thing for our case? And there is any trouble for her son? I am so worry about this.

On paperwork for visa DS-230 indicate accompanying children, they should get derivative visa, and fill out additional DS-230 for the child.

Evidence for child will be birth cert proving relationship, and letter from father allowing the child to leave the country.
