Hello All,

I am new to this forum and wanted to request assistance from you. I just got married a few weeks ago and received our marriage certificates in the mail. My wife is currently in the US on a student visa and I wanted to start the process of making her a permanent residence. I've been doing some research and there are so many forms so I don't want to mess up. Therefore, I just wanted to verify that I am filling out all necessary forms. To my understanding I need to fill out the following:

I 130

G-325 A for both myself and my wife

I 485

I-864

I-131

I-693

Does this sound about right or am I missing anything?

Do I send all these documents at once and together?

Do all these documents go to the same address?

Is it ok to submit the I-130 and I-485 at the same time?

If anyone can assist me and point me in the right direction so that I can get started, I would greatly appreciate it.

It appears that you are filing for an Adjustment of Status.

Also note, you should check your fiance's student visa to make sure there's not a home residency clause.

Some student visas carry a mandatory clause that the student must return to their home country for a specified period of time.

You can submit the forms together but need a separate check for the I-130, then one for $1010 for rest. You each need a G325a for the I-130 but she'll need a separate one to go with the I-485. Think of each form as a stand-alone petition or application, even though you'll mail them in the same envelope. Be sure to include the I-693a vaccination suppliment as well.

If you wife is on a J-1 visa, look at it to find out if she has a home stay requirement. If so, you have a big monkey wrench in you plans.

Dear Forum Members!

First of all, I'd like to thank everyone here for all the valuable information. It's really great!

I am new to the forum and I thought I would ask my question in this thread since the situation described here is exactly like mine.

My wife to be is a international student w/ an F1 and we will be filing for an AOS (adjustment of status).

I am a little confused by two links that I would on this forum which have some conflicting information. My goal is to get the AOS as quickly and as safely as possible. :)

I read the Step-by-Step Guide on How to File an I-130 for a Spouse Inside the US and LingChe NVC ShortCut

I think that the shortcut does apply to my situation but I am not sure.

Based on LingChe's shortcut my steps (brief) are to be as follows:

1. Send I-130, G320 and other required documents to USCIS.

2. Then wait for the petition to be approved, case is transferred to NVC and an NVC number is issued.

3. When that is done, the DS-3032 and Affidavit of Support fee bills will be generated.

4. Send the DS-3032 (Choice of Agent form) to continue processing.

5. Once I am allowed to pay for the Affidavit of Support, pay for it and send in the I-864 AOS Package to NVC.

6. Once I am allowed to pay for the IV, pay for it and send in the DS-230 Package to NVC.

However, in these steps there is no mention of the I-485 or I-693? :unsure:

I assume that I would send the I-485 when I send in the I-864? Same goes for I-131 (Application for travel), I-693 and I-693A and G320A? Would I send all of these to NVC or USCIS?

You have referred to a guide for using the I-130 for a visa. Follow the AOS guide. NVC will not be a part of the process as NVC is National Visa Center. You are not in a visa process and neither is the OP. This thread should have been moved to the AOS forum long ago.
