I call and E-mailed those texas lawyers but none of them get back to me. I spoke with a lawyer here in NYC and she told me all I can do is oppose it.

About the NOID, what is that? They didn't stamp anything on my fiances passport they just gave us the sheet with the 212(a)(5)(A) highlighted.

K-1 Timeline

I-129F Sent - 3/4/2008

I-129F Recieved - 3/5/2008

I-129F Approved - 5/7/2008

Interview Date - 8/26/2008 - (Asked for petitioner to be interviewed as well, new interview Date 9/18/2008)

Interview 2 Date - 9/18/2008 - (Case Sent to review, and not DENIED as I orignally thought)

Gave up on K1 process - 9/19/2008

Canceled K-1 Petition - 5/1/09

Married - 5/30/2009

Recieved K-1 2nd Approval (HA!) - 6/6/2009

Long Honey Moon - 5/30/2009-10/14/2009

NOID notice of intent to deny

The sheet with 212(a)(5)(A) highlited is called the NOID, as estadia stated, Notice of Intent to Deny.

In the end it is the same but only the USCIS can issue a NOID letter. The consulate refuses to issue the visa and issues a 212(g). The petition is returned to the USCIS and the USCIS can either let the petition expire or issue a NOID letter. As a practice, the USCIS lets petitions expire and does not so much physically or actually issues NOIDs anymore.

So I spoke with a lawyer, and he says that we need to send a letter to the Embassy so that they don't send back the petition to immigration services so I could get another interview. He'll do everything for $2500

I'm worried because I don't know if he could actually do this. I don't know what to do now, if to go for the lawyer and try to get another interview, or if I should just abandon the whole K1 ad go for the marriage visa.
