Can anyone tell me if the I-94 expires when the passport expires? My husband just arrived on February 3rd with his K-3 visa and we are going to start AOS and get his EAD as soon as possible. But due to problems getting his passport renewed (we wanted to get a 5 year) before he had his interview, the passport will expire in July of this year. What do we need to do? Will the AOS be done before then or do I need to try to get another passport from a local consulate? How then do I get a new VISA put into the new passport?? :help:

02-03-2006 Received K-3 Visa.

02-21-2006 Filed I-485 and I-765 with lawyer.

03-04-2006 Received NOA on both AOS and EAD.

03-21-2006 Biometrics for AOS & EAD.(Our 3rd Wedding Anniversary)

03-22-2006 AOS & EAD Touched.

03-23-2006 AOS & EAD Touched.

03-31-2006 Emily's Birthday ~ 2 Years Old

03-31-2006 AOS & EAD Touched. (Could be from the AR-11 and I-865 Change of address forms).

04-03-2006 AOS & EAD Touched.

05-09-2006 USCIS Site states that EAD was approved.

05-11-2006 Received EAD Card in the mail.

06-05-2006 Received AOS Interview letter.

07-26-2006 AOS Interview - APPROVED.

07-31-2006 Received WELCOME letter in the mail.

07-31-2006 Received E-mail -- Card is on the way.

08-05-2006 Received Green Card -- Good for 10 years.

11-08-2006 New addition to the family - Anali Grace was born

The I-94 expires on the expiry date annotated on the I-94. Even if the passport expires, the I-94 does not if the I-94 expiry date has not been reached.

In general, if his passport is expiring, you should get it renewed. Don't worry about the I-94, even if it sits in an old and invalid passport, it is still valid if its expiry date has not been reached. And besides, once you apply for adjustment your status changes to that of adjustment applicant anyway.

Here is his visa/I-94 with valid information covered, is the date on the I-94 (July 12, 2006) the expiration date of the I-94??

When he gets a new passport, do we have to get a new visa or is this what will not matter since we will be AOS?
